These Terms of Use (“Terms”) are a contract between you and the operator of batas.org (“BATAS”, “we”, “us”). They govern your access to and use of the batas.org website, the Batas desktop application, our narrated courses, the law library, mock Bar examinations, the Exam Day proctored examination service, the AI study and grading tools, playlists, and every other feature we offer (together, the “Service”). Read them before you create an account. If you do not agree with them, do not use the Service.
1. Who we are, and the information we are required to publish
The Service is owned and operated by:
- Business/Trade name used online: BATAS · batas.org
- Office address: ASG Law, 282 P. Ocampo Sr. Extension, San Antonio Village, Makati City, Philippines
- Email address: batas.org@gmail.com
- Data Protection Officer: batas.org@gmail.com
We publish the information above on this page, and on our homepage and account-creation pages, in line with the Internet Transactions Act of 2023 (Republic Act No. 11967) and its implementing rules, the Consumer Act of the Philippines (Republic Act No. 7394) and the E-Commerce Act (Republic Act No. 8792).
This is a Philippine service. We offer it to learners anywhere, but the contract is governed by Philippine law (see §21).
2. At a glance — the short version
This summary is only a reading aid. It does not change the rest of these Terms.
- BATAS is a study aid for law students, bar candidates, and lawyers. It is not legal advice, and using it does not create a lawyer–client relationship.
- We work hard on the materials, but they are provided without warranty and may contain errors, omissions, or outdated law. Always verify against the official text — the Constitution, the law as published in the Official Gazette, the Rules of Court, and Supreme Court decisions as issued by the Supreme Court.
- We do not guarantee any result. We do not promise that you will pass the Bar, any bar examination, any law-school subject, any quiz, or any grading. Nobody can honestly promise that.
- Your obligation to pay, once it has arisen, is real; our obligation to keep the Service running is limited as set out in §15 and §19.
- You keep the rights in what you write. We keep the rights in what we built (§11–12).
- Your personal data is handled as described in our Privacy Policy and in the Data Privacy Consent you accept when you register.
3. Accepting these Terms
By signing up, by signing in, by subscribing, by purchasing a pass, by uploading an answer for grading, or simply by continuing to use the Service, you agree to be bound by these Terms, the Privacy Policy, the Data Privacy Consent, and the Refunds, Cancellation & Subscriptions Policy.
When you create an account, we record the fact that you accepted these documents, together with the version of each document you accepted and the date and time of your acceptance. That record is the evidence that a contract was formed between us. We keep it because the National Privacy Commission requires controllers to be able to demonstrate that consent was given.
You confirm that you have had the opportunity to read these Terms, that you understand them, and that you accept them freely. If you are accepting on behalf of an organisation, a law school, a review centre, or a student organisation, you confirm that you are authorised to bind that organisation to these Terms.
4. Who may use the Service
You must be at least eighteen (18) years old to create an account and to buy anything on the Service.
If you are between thirteen (13) and seventeen (17) years old, you may use the Service only with the consent and active supervision of a parent or legal guardian, who must agree to these Terms and to the Privacy Policy on your behalf. Where a learner under eighteen registers, we treat the parent or guardian as the contracting party and as the person who gave consent to the processing of the learner’s personal data. We do not knowingly create accounts for, or process the personal data of, children under thirteen. If you believe a child under thirteen has registered, write to batas.org@gmail.com and we will remove the account.
You must not use the Service if you have previously been banned from it, or if using it would break any law that applies to you.
5. Your account
- One account per person. Accounts are personal and non-transferable. You may not share your credentials, sell access, or let another person use your account, including to read library material or to download course audio.
- True information. The name, email address, mobile number, and school you give us must be true and yours. A false name or a borrowed email address is a breach of these Terms and can be grounds for termination. If you enrol through a partner school’s code, a truthful school entry is what links you to that programme.
- Security. You are responsible for keeping your password secret and for everything done through your account. Tell us at once at batas.org@gmail.com if you believe someone else has your credentials. We are not liable for losses that follow from your failure to keep your credentials safe.
- Account changes. You may change your name, school, password and email address from your account settings. To change the email address we send an approval link to the new address before the change takes effect.
- Closing your account. You may ask us to close your account at any time by writing to batas.org@gmail.com. Closing an account does not by itself entitle you to a refund (see the Refunds Policy), and it does not delete records we must keep for tax, accounting, or legal-reason purposes.
- Identity verification. Professors, reviewers, and partner-school users who need to author or proctor secure examinations must complete identity verification: one government-issued identification document (front, and back where available) and a selfie holding it, together with your legal name, the ID type and number, and optionally your institution and position. Those documents are stored in encrypted form, are accessible only to authorised BATAS administrators, are used only to verify your identity, are never used for advertising, and are deleted when you withdraw a pending request. See §13 and the Privacy Policy.
6. What the Service is — and what it is not
What it is. BATAS is an educational review platform. It provides narrated lessons that read the law out loud while the text is highlighted, codal and case materials, quizzes, mock Bar examinations with model answers and rubrics, study scheduling, case-brief playlists, and artificial-intelligence study and essay-grading tools.
What it is not.
- It is not legal advice. Nothing on the Service — including lesson narration, AI answers, model answers, sample pleadings, memoranda, or grading feedback — is legal advice, and no attorney–client relationship is created by using it. For advice on a real matter, consult a Philippine lawyer.
- It is not a law school, and it is not an accredited programme. We are not affiliated with the Supreme Court, the Bar Confidant, the Office of the Bar Chairperson, the Legal Education Board, or any law school, and nothing we publish is an official publication of any of them. Completing a BATAS course does not earn academic credit, does not create any exemption, and does not substitute for a law degree or a bar review course.
- It does not examine you for anyone. Mock Bar and practice examinations are private practice. A BATAS score is our internal estimate under our own rubric. It is not a Bar rating and has no official status.
- It is not a substitute for the official sources. Where our summary and the official text differ, the official text governs.
7. Educational content, the law library, and AI features
7.1 Our materials. We write, narrate, and compile our lesson and review materials ourselves, using public-domain sources — the Constitution, the codals as published, the Rules of Court, and Supreme Court decisions — together with our own commentary, digests, questions, rubrics, and recordings. We cite the law and the courts. We do not cite or reproduce third-party review material.
7.2 The law changes; materials age. Statutes are amended, repealed, and renumbered; the Supreme Court reverses itself; rules are revised. A module recorded before an amendment may describe the old rule. We do not promise that any material is current as of any particular date, and we do not undertake to update any particular module. Where it matters to you, check the date of the material and confirm the present state of the law against the official source.
7.3 Artificial-intelligence features. Parts of the Service use artificial-intelligence services to answer study questions, to draft explanations, to compile briefs, to generate voice narration, and to grade essay answers. You should understand and accept the following:
- AI output can be wrong, incomplete, outdated, or invented — including citations to cases and provisions that do not exist. Treat every AI answer as a draft hypothesis to be checked, never as authority.
- Essay grading is automated. When you submit an essay, an automated system scores it against a question-specific rubric and returns a score, a critique, and sample reasoning. The score is an estimate produced by software, is advisory, and will not always match how a human examiner or Bar examiner would grade the same answer. It is not a prediction of your Bar result.
- Automated decisions. We do not make decisions that produce legal effects, or similarly significant effects, on you through automated processing alone. Your access, your enrolment, and your certificates are decided by the rules described in these Terms and are not scored by the AI system. Essay scores are study feedback, not a decision about your rights.
- Human review. If you believe an automated score is wrong, write to batas.org@gmail.com and we will have a person review the grading output.
- What we send to AI providers. To answer a question, the text of your question and the relevant lesson or document excerpt are transmitted to the AI provider. To grade an essay, your answer, the question, and the rubric are transmitted. Do not submit anything you are not willing to have processed this way, and never submit confidential client information or privileged material belonging to a real matter.
- Our providers are prohibited by their own terms, and in some cases by contract, from using what we send them to train their models. See the Privacy Policy for the current list of processors.
7.4 Voice narration and audio. Narration audio is generated and streamed to your device with signed, expiring links. Audio is licensed to you for personal study only (see §11). Circumventing a signature, expiry, or access check to keep, copy, or redistribute audio is a breach of these Terms and may also be an offence under Republic Act No. 10175 (Cybercrime Prevention Act of 2012).
8. Plans, prices, payment, and renewal
8.1 Plans. We sell a free account and a Bar Review pass (seasonal, and sometimes with a 0% instalment plan), together with consumable AI token packs. We may also offer other programme lines from time to time, including a monthly all-access plan for one or more of those lines; whatever is on sale, and the current price of each item, is shown on the pricing and checkout pages at the moment of purchase. Prices may be changed at any time; a change never applies retroactively to a period you have already paid for.
8.2 The price you see is the price you pay, and whatever is added appears before you pay. All prices are in Philippine pesos and, where applicable, include the taxes we are required to charge. Any instalment arrangement, add-on, or processing fee is disclosed before you confirm.
8.3 Automatic renewal. A plan we sell on a recurring basis renews automatically for the period stated at checkout, until you cancel it. When you buy such a plan, you authorise us (through our payment processor) to charge your chosen payment method at the start of each period, at the then-current price, until you cancel. We will tell you in advance of any increase in the amount charged, and you may cancel before it takes effect. Instalment plans for a Bar Review pass follow the schedule shown at checkout, and access ends if the schedule is not followed.
8.4 Cancelling. You may cancel at any time from your Billing page, or by writing to batas.org@gmail.com. Cancellation stops the next charge. It does not refund the current period, which continues to its end (see the Refunds, Cancellation & Subscriptions Policy).
8.5 Payment processing. Card and e-wallet payments are processed by a third-party payment processor. We receive the result of the transaction and a reference number; we do not receive or store the full number of your card.
8.6 Receipts and invoices. We issue an electronic receipt or invoice for every sale. It is available in your Billing page and can be emailed to you at any time on request. Tell us your registered business name and TIN if you need a business receipt.
8.7 Failed payments. If a renewal charge fails, we may retry it and may suspend paid features until it succeeds. Suspension for non-payment is not a termination of your account, and your free content remains available.
8.8 Promotions, discounts, and codes. Discount codes and partner codes are personal and single-use unless the offer says otherwise, have no cash value, cannot be duplicated or transferred, and may be withdrawn or corrected if a code was issued or used by mistake or in breach of its terms. A promotional price applies only to the period or scope described in the offer.
9. Refunds and cancellation
Refunds, cancellations, and instalments are governed by the Refunds, Cancellation & Subscriptions Policy, which forms part of these Terms. Nothing in that policy removes any right you have under the Consumer Act of the Philippines or the Internet Transactions Act of 2023.
10. Acceptable use
You agree not to do any of the following, and not to help anyone else do them:
- Copy, record, download, redistribute, resell, sublicense, publish, or share any lesson, narration, audio clip, question, rubric, model answer, brief, or document obtained through the Service, except as §11 expressly allows.
- Share your account or credentials, or use another person’s account.
- Scrape, crawl, harvest, or bulk-download the Service or the law library, whether by robot, script, browser extension, or manual repetition, or use the Service to build or train another product.
- Circumvent, disable, or interfere with access controls, signed or expiring links, enrolment gates, progress locks, proctoring, rate limits, or any other technical protection measure.
- Reverse engineer, decompile, or attempt to extract the source code, prompts, models, or internal data of the Service, except to the extent that the law expressly permits despite this restriction.
- Use the AI tools to answer live examination questions, to sit an examination for another person, or to complete assessed coursework you are required to do yourself. Using the Service in an examination where it is prohibited is an academic-integrity breach and may also be a disciplinary or criminal matter under the rules of your school and under Republic Act No. 10175.
- Upload or transmit anything unlawful, defamatory, obscene, malicious, or infringing; anything containing malware; or anything designed to damage, overload, or gain unauthorised access to the Service or another person’s device or data.
- Attempt to access another learner’s account, data, answers, or examination records, or use the proctored examination facilities for anything other than a legitimate examination.
- Misrepresent your identity, your school, your qualifications, or your authority to act for an institution.
- Use the Service to give legal advice to the public, or to hold out your BATAS use, certificate, or score as a professional qualification.
We may investigate suspected breaches, may suspend or terminate accounts involved, and may report conduct to the proper authorities, including the National Privacy Commission, the Department of Trade and Industry, the National Bureau of Investigation, and the Philippine National Police.
11. Academic integrity and proctored examinations
BATAS supports law schools and reviewers who schedule secure, proctored examinations through the Exam Day service. Where an examination is marked as proctored or secure, you agree to sit it yourself, alone, without unauthorised material or assistance, and to follow the instructions given by the examiner or proctor. You accept that the Service may record examination metadata — times, session events, browser-window audit events, submission hashes, and identity-verification status — and may report integrity signals to the examiner who scheduled the examination. Attempting to defeat proctoring, impersonating a candidate, or obtaining questions in advance is a serious breach of these Terms, will result in termination without refund, and may be reported to the school or institution that scheduled the examination. This does not apply to practice quizzes and mock examinations that you take for yourself.
12. Intellectual property
12.1 Ours. The Service, the batas.org name and marks, the design and code of the website and desktop application, our lesson scripts and commentary, our questions, rubrics, model answers, digests, compilations, charts, and every recording we produce are owned by us or licensed to us, and are protected by the Intellectual Property Code of the Philippines (Republic Act No. 8293) and by our terms with our licensors. All rights not expressly granted are reserved.
12.2 Yours. You keep whatever rights you have in the answers, essays, questions, and comments you submit. To run the Service we need a licence to handle them, and by submitting them you give us a worldwide, royalty-free, non-exclusive licence to store, process, transmit, display, and use them for the limited purposes of operating the Service: delivering your feedback, grading your answers, showing you your history, backing up and securing our systems, and improving the reliability of the Service. We do not publish your essays, do not put your name to them, and do not use them in marketing without a separate, specific permission from you. This licence ends when you delete the submission or close your account, except for copies in encrypted backups and copies we must keep as records.
12.3 Public-domain sources. The text of Philippine statutes, the Rules of Court, and Supreme Court decisions is not our property and is not covered by the licence in §11. Section 176 of the Intellectual Property Code provides that no copyright subsists in any work of the Government of the Philippines, subject to the conditions stated there. We may claim rights over our selection, arrangement, summaries, narration, and annotations of such material.
12.4 Your licence to use the materials. Subject to these Terms and to payment of the applicable fee, we grant you a personal, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use the Service and its materials for your own study and, if you are a professor or reviewer using the Exam Center, for teaching your own students. You may not use the materials commercially or in your own product.
12.5 Complaints. If you believe material on the Service infringes your rights, write to batas.org@gmail.com with the details of the work, the material concerned, and your authority to complain. We investigate and remove material where a complaint is well founded.
13. Privacy and personal data
We are a personal information controller under the Data Privacy Act of 2012 (Republic Act No. 10173). Our Privacy Policy explains what we collect, why, on what lawful basis, for how long we keep it, who processes it, and how to exercise your rights as a data subject. The Data Privacy Consent contains the specific consents you give when you register, including consent to the processing of sensitive personal information where the Service needs it (for example the school or educational information you enter, and the government-issued identification you submit if you verify your identity).
Some of the data we process — identification documents, school and educational information, payment records — is sensitive personal information, and we process it only on a lawful basis, under appropriate security measures, and for the specific purposes we have told you about. We do not sell personal data, and we do not trade it. Our processors act on our instructions under written agreement. See the Privacy Policy for your rights and for how to contact our Data Protection Officer.
14. Third-party services
The Service depends on third parties: payment processing, identity sign-in (for example Google Sign-In), cloud hosting and storage, content delivery, email delivery, artificial-intelligence and text-to-speech providers, and application updates. When you use a feature that a third party provides, that party’s own terms and privacy notice also apply to its part of the interaction. We are not responsible for a third party’s service, and we do not control it. Where a third party’s service is down, the corresponding BATAS feature may be unavailable.
Links to other websites are provided for convenience. We do not endorse and are not responsible for their content.
15. Availability, changes, and discontinuation
We aim to keep the Service available, but we do not promise uninterrupted or error-free operation. The Service may be unavailable during maintenance, upgrades, provider outages, or events outside our control, and we may change, add, suspend, or remove features.
We may discontinue the Service, or any course, module, library collection, or feature, at any time. If we permanently discontinue the paid Service as a whole, we will give reasonable advance notice on the Service and by email, and we will refund the unused part of any prepaid period. If we discontinue a single course or module, we will give you the option of continuing on an equivalent part of the Service you paid for; if we cannot offer an equivalent, we will refund the proportionate unused part of the prepaid period attributable to it. A module, question, or library item may be removed at any time where a court order, a takedown demand, a copyright or data-privacy concern, or a legal change requires it.
Beta or preview features are offered as-is, may change without notice, may contain errors, and may be withdrawn at any time.
16. Suspension and termination
By us. We may suspend or terminate your access, with or without notice, if: you breach these Terms (including the acceptable-use and academic-integrity rules); we are required to do so by law, by a court, or by a regulator; we reasonably believe your account is being used fraudulently, has been taken over, is being shared, or is being used to harm the Service or another person; or payment fails and is not cured. Where the breach is serious — credential sharing, commercialised redistribution of our materials, scraping, proctoring fraud, or an attack on the Service — we may terminate immediately and without refund.
By you. You may stop using the Service at any time, and may ask us to close your account as §5 describes.
Effect. On termination, your licence to use the Service ends, your access stops, and your enrolment ceases. Sections that by their nature should survive — intellectual property, disclaimers, limitation of liability, indemnity, governing law, and the Privacy Policy’s retention provisions — survive termination.
17. No warranty — the Service is provided “as is”
To the fullest extent permitted by Philippine law, and subject only to §17.4:
17.1 The Service and everything in it are provided “as is” and “as available”, without warranty of any kind, whether express, implied, or statutory, including any implied warranty of merchantability, of fitness for a particular purpose, of accuracy, of completeness, of timeliness, of title, or of non-infringement.
17.2 We do not warrant that: the Service will be available, uninterrupted, timely, secure, or free of errors, viruses, or harmful components; that defects will be corrected; that any material, answer, summary, digest, question, rubric, AI output, or narration is accurate, complete, current, correct in citation, or suitable for your purpose; that the law library is complete or the search results exhaustive; that an AI feature will answer correctly or answer at all; that an automated essay score will match a human examiner’s assessment or any official rubric; or that anything you learn will be retained by you.
17.3 You use the Service, and rely on anything it produces, at your own risk and on your own judgement. You accept that law-study materials must be verified against official sources, and that you are the person best placed to do that verification for the material you rely on.
17.4 What this clause does not do. Nothing in this §17 excludes or limits any warranty, right, or remedy that Philippine law does not allow us to exclude — including the implied warranty in Article 69 of the Consumer Act of the Philippines that a service will be rendered with due care and skill and that the material supplied with it will be reasonably fit for its purpose, and the rule in Article 167 of that Act that its provisions apply notwithstanding any agreement to the contrary. Nothing in these Terms waives liability for fraud, for bad faith, or for gross negligence, and nothing waives a claim for anything the law says cannot be waived (see Article 1171 of the Civil Code, which makes void any waiver of an action for future fraud). Where the law gives you a warranty we cannot exclude, that warranty applies, and this §17 operates only to the extent the law permits.
18. No guarantee of results
This section is important, and it is deliberate. Please read it in full.
18.1 We do not guarantee any result. We make no promise, guarantee, warranty, or representation that: you will pass the Bar examination, in any subject or overall, in any attempt; you will improve your score by any particular amount; you will pass any law-school subject, examination, quiz, recitation, or interview; you will be admitted to the Bar or to any school; you will obtain or keep any licence, position, job, or promotion; or you will achieve any particular rank, rating, or result of any kind. We cannot guarantee any of that, and no honest provider can.
18.2 No pass-rate claim. We do not publish a pass-rate promise, a “pass or your money back” guarantee, or any similar assurance. If a claim of that kind ever appears in our marketing, in an affiliate’s material, or in a partner’s material, it is not authorised by these Terms and it does not bind us; please tell us at batas.org@gmail.com so we can correct it.
18.3 Results depend on you and on many things we do not control. Examination results depend on your prior preparation, your reading, the hours you put in, your health and circumstances, the difficulty of the particular examination, the examiner’s discretion and grading judgement, the applicable rules and their interpretation, quota and ranking systems, and factors outside anybody’s control. A review platform is one input among many.
18.4 What we do commit to. We commit to the standard of care in §17.4: that the Service is developed and delivered with the due care and skill of a professional provider of legal-education technology, and that we correct material errors we are told about, where we can, in the ordinary course of maintaining the Service. That is our commitment. It is not a promise of an outcome.
18.5 Rank, scores, certificates, and estimates. Percentile ranks, estimated scores, readiness indicators, and comparisons shown in the Service are statistical estimates computed from the questions you answered and from the pool of answers we hold. They are study tools, not predictions, and they are not a measurement of your ability or of your likely official result.
19. Limitation of liability
19.1 To the fullest extent permitted by Philippine law, our total aggregate liability to you — on any theory, whether contract, tort, negligence, strict liability, or otherwise — arising out of or connected with the Service or these Terms is limited to the total amount you actually paid us for the Service in the twelve (12) months immediately before the event giving rise to the claim.
19.2 To the fullest extent permitted by law, we are not liable for indirect, incidental, special, exemplary, punitive, or consequential loss; for lost profits, lost income, lost opportunity, lost employment, lost professional advancement, or lost or corrupted data; for the cost of substitute services; or for any loss arising from delay, non-performance, or interruption caused by an event outside our reasonable control, including network or hosting failure, cyber-attack, power failure, providers ceasing to supply a service, labour disputes, governmental or judicial action, and natural disaster (see Article 1174 of the Civil Code).
19.3 Nothing in this §19 excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or bad faith, for gross negligence, for death or personal injury caused by our fault, or for any liability that the Consumer Act of the Philippines (including Articles 105, 106, and 167), the Civil Code, or the Data Privacy Act of 2012 does not permit us to limit. Where a consumer right cannot be waived, this §19 does not waive it, and these Terms operate only so far as the law allows. If you are a consumer, you may assert your rights before the Department of Trade and Industry, before the courts, and — for personal data matters — before the National Privacy Commission.
19.4 The limits in this §19 apply even if a limited remedy is found to have failed of its essential purpose, and they are a fundamental basis of the price we charge.
19.5 If §19.1 or §19.2 is found unenforceable as to a particular claim, the balance of the section continues to apply to every other claim.
20. Indemnity
To the extent permitted by law, you will indemnify and hold us, our owners, officers, employees, and contractors harmless against third-party claims, losses, liabilities, and reasonable costs (including reasonable attorney’s fees) that arise from your breach of these Terms, your misuse of the Service, your infringement of another person’s intellectual-property or privacy rights, or your uploading of unlawful content. This does not apply to the extent the claim was caused by our own fault, and it does not require you to indemnify us for claims that we are obliged to bear under the Consumer Act or the Data Privacy Act.
21. Governing law, complaints, and dispute resolution
21.1 Governing law. These Terms, and every dispute arising out of or connected with them or the Service, are governed by the laws of the Republic of the Philippines.
21.2 Talk to us first — our internal redress mechanism. If you have a complaint, a problem with a purchase, a failed payment, an unfulfilled purchase, a content error, or a privacy concern, write to batas.org@gmail.com with your account email, the reference number of the transaction, and what you want us to do. We acknowledge complaints promptly and aim to resolve them in writing. Under the Internet Transactions Act of 2023 and its implementing rules, we maintain this internal redress mechanism, and we treat it as exhausted if your complaint is not resolved within seven (7) calendar days. A request about your personal data is handled under the Privacy Policy, where the timelines are longer.
21.3 Where to complain. If we do not resolve the matter, you may bring it to:
- Consumer complaints: the Department of Trade and Industry, and the DTI Online Dispute Resolution facility for online transactions at https://odr.dti.gov.ph;
- Data-privacy complaints: the National Privacy Commission, privacy.gov.ph;
- Electronic-commerce and online-business complaints: the Department of Trade and Industry – E-Commerce Bureau;
- Criminal matters: the appropriate prosecution service and courts, including for offences under Republic Act No. 10175 (Cybercrime Prevention Act of 2012).
21.4 Venue. Subject to any right you have as a consumer to sue where you reside, and to the rules on small claims, the parties submit to the exclusive jurisdiction of the courts of Makati City, Philippines, and agree to bring suit only there.
21.5 No class action is agreed. Each dispute is resolved between you and us individually. This clause does not prevent you from bringing any claim before a government agency, nor does it limit a right that Philippine law gives you and does not allow us to set aside.
22. Changes to these Terms
We may update these Terms — for example when the law changes, when we add or remove features, or when we change a price or a plan. Every version is dated and numbered, and the version you accepted is recorded at registration.
Where the change materially affects your rights or obligations — a limitation of liability, a price change effective mid-term, a change in what personal data we collect or how we use it — we will give you notice by email or in the Service before it takes effect, and, where the change concerns the processing of your personal data and requires your consent, we will ask for consent again and will not apply the change to your data until you give it. If you do not accept a change, you may cancel before it takes effect; continuing to use the Service after it takes effect means you accept the new version. Changes never apply retroactively to a dispute that arose under an earlier version.
Version history of this document
- 1.2 — the plan list in §8.1, and the automatic-renewal clause in §8.3, describe the line-up actually on sale: Bar Review only, with any recurring plan stated conditionally.
- 1.1 — the operator’s office address, email address and Data Protection Officer are stated directly, and the venue clause names Makati City.
- 1.0 — first version.
23. General provisions
- Entire agreement. These Terms, together with the Privacy Policy, the Data Privacy Consent, and the Refunds, Cancellation & Subscriptions Policy, are the whole agreement between us on their subject matter and replace any earlier understanding.
- Advertising and marketing. Our marketing pages, course descriptions, comparisons, and offers are not contractual promises. Where an offer or promotion conflicts with these Terms, the specific terms of the promotion govern, and these Terms govern everything else.
- Severability. If a provision is held void or unenforceable, it is modified to the least extent necessary or severed, and the rest of these Terms continues in force.
- No waiver. Our failure or delay in enforcing a provision is not a waiver of it, and a waiver on one occasion is not a waiver on another.
- Assignment. You may not assign or transfer your rights under these Terms. We may assign them to an affiliate or to a successor in a merger, acquisition, or sale of assets, on notice to you; a change of control does not change how your personal data may be processed under the Privacy Policy then in force.
- Notices. We give notice to the email address on your account, or in the Service, or on this page. You give notice to batas.org@gmail.com. Notices by email are treated as received on the day they are sent.
- Electronic records. You agree to transact and receive notices electronically, and to the use of electronic records, signatures, and documents under the E-Commerce Act (Republic Act No. 8792) and the Rules on Electronic Evidence. Our records of your acceptance of these Terms are admissible as evidence of it.
- Language. These Terms are written in English, which is the language of these Terms and of our communications with you.
- Force majeure. Neither party is liable for a failure to perform caused by an event outside its reasonable control, as provided in Article 1174 of the Civil Code.
- No third-party benefit. No person who is not a party to these Terms may enforce any of them, except that our licensors and processors may rely on the provisions that protect them.
