This is the consent you give when you create a BATAS account. It is written to be read. It states, in the order the law requires, what you are consenting to, why, who else will handle your data, how long it is kept, and how you take your consent back. It sits alongside our Privacy Policy, which explains everything in more detail, and our Terms of Use.
1. What this consent is, and what makes it valid
Under the Data Privacy Act of 2012 (Republic Act No. 10173) and the National Privacy Commission’s guidelines on consent, your consent has to be freely given, specific, informed, and expressed by a clear act. It cannot be buried in a general acceptance, cannot be a pre-ticked box, and cannot be a condition you cannot refuse.
That is why:
- You give this consent by ticking the box yourself on the account-creation form. The box starts empty, and the account cannot be created until you tick it. We record which version of these documents you accepted and when.
- Every consent below is stated separately, so you know exactly what you are agreeing to. If a purpose is optional, we say so and let you choose.
- You may withdraw, and withdrawing is as easy as consenting: one email to our Data Protection Officer, or the settings in your account.
2. What you consent to when you create an account
2.1 Running your account and delivering the Service — required
I consent to BATAS collecting and processing my full name, email address, mobile number, school or educational institution, chosen plan, and the password I choose, and to recording my learning record (the lessons, audio and documents I open, the quizzes and mock examinations I take, my answers, my scores, my progress and streak, and the certificates issued to me), for the purposes of:
- creating, securing, and administering my account;
- signing me in and recognising me on the Service;
- delivering the courses, library, examinations, playlists, and features I use;
- showing me my own progress, and giving me my own study feedback; and
- contacting me about my account, my purchases, my security, and changes to the terms I have accepted.
I understand that this processing is also necessary to perform the contract between me and BATAS, and that consenting to it is a condition of creating an account.
2.2 The school or institution I write in — required (sensitive personal information)
I consent to BATAS processing the school, college, university, review centre or other institution I name — which is information about my education, and therefore sensitive personal information under the Data Privacy Act — for the purposes of identifying my programme, giving me the right course content and academic calendar, administering any school or partner code I use, and supporting the group or institution through which I am studying.
If I do not wish to name an institution, I will choose the option for learners who are not in law school, so that this consent is not required of me.
2.3 Artificial intelligence features — for the features you use
I consent to BATAS transmitting, to the artificial-intelligence and speech providers listed in the Privacy Policy, the parts of my use that the AI features need in order to work:
- when I ask a study question, the text of my question and the relevant lesson or document excerpt;
- when I submit an essay or an examination answer for automated grading, the text I submit, the question, and the rubric;
- when I ask for narration, the course text to be spoken (which does not contain my personal data).
I understand that these providers process the text to produce the answer, the audio, or the score and critique, on BATAS’s instructions and under obligations not to use it for their own purposes or to train their own models; and I understand that automated grading produces an estimate that can differ from a human examiner’s assessment, and that I may ask for a human review.
2.4 What I should not send — my confirmation
I confirm that I will not submit another person’s personal data, and will not submit privileged or confidential information belonging to a client or to any real legal matter, to the AI features or anywhere else on the Service.
2.5 Identity verification — only if I apply for it, and given separately
Identity verification is optional and is required only for users who need to author or proctor secure examinations (professors, reviewers, and partner-school users). I will not be asked for my identification unless I choose to apply. If I apply, I give that consent on the verification form itself, where I will also be told exactly what is collected — my legal name, the type and number of my identification document, optionally my institution and position, the front of the document (and the back where I provide it), and a selfie holding it — that it is processed only to verify that I am who I say I am and to protect the integrity of examinations, that it is encrypted, that it is accessible only to authorised BATAS administrators, that it is never used for advertising, that it is not shared with any institution without my further consent, and that the images are deleted when I withdraw the request, when the verification lapses, or when my account is closed.
I understand that the images of a government-issued identification document are sensitive personal information, and that withholding this consent costs me nothing except the ability to verify my identity and to author or proctor secure examinations.
2.6 Proctored examinations — only where an examiner schedules one
If I sit a proctored or secure examination scheduled by an institution, I consent to BATAS recording examination metadata and integrity signals — the times of my session, session events, browser-window audit events, and submission records — and to reporting those signals to the examiner or institution that scheduled the examination, for the purpose of protecting the integrity and fairness of that examination. I understand that this does not apply to practice quizzes and mock examinations that I take for myself.
2.7 Payment and receipts — required for a paid plan
If I buy a plan, I consent to BATAS processing my order details, billing name, business name and TIN where I give them, payment reference, amount, and the outcome of the transaction, and to receiving them from our payment processor, so that payment can be taken, a receipt or invoice issued, refunds and chargebacks handled, and the records kept that tax and accounting law requires. I understand that my card and e-wallet details are entered on the payment processor’s own pages and that BATAS does not receive or store the full number of my card.
2.8 Sending me things — optional, and separate
I am not asked to agree to this, and nothing is withheld from me if I refuse. We do not send promotional email to a learner who has not separately consented to receive it. If we ever offer a newsletter or course offers, you will be asked for that consent at the point of offer, with its own tick-box, and you may withdraw it at any time. Service messages — receipts, failed-payment notices, security warnings, and notices of changes to the documents you accepted — are part of the Service and are not marketing.
3. Who else handles my data, and where
I understand that BATAS uses service providers — for cloud hosting and storage, payment processing, sign-in, artificial intelligence, speech synthesis, content delivery, and email delivery — that process my data only on BATAS’s written instructions, under confidentiality and security obligations, and not for their own purposes. The current list of providers, what each one handles, and where processing takes place are set out in the Privacy Policy (§6 and §8), including the transfer of personal data outside the Philippines where a provider is located abroad and the safeguards that apply to it.
I also understand that if I enrol using a code belonging to a law school, review centre, or student organisation, or if the school I name is a BATAS partner, my account is linked to that institution, and that the institution sees aggregate figures about its linked learners — not my individual answers, essays, grades, or study history.
4. How long my data is kept
I understand that BATAS keeps my account, profile, and learning record while my account is open, and deletes or anonymises them within thirty (30) days after I close my account or ask for erasure, except for the records the law requires BATAS to keep: order, receipt and accounting records for five (5) years; records proving that I consented, for five (5) years after the processing ends; records of a verification that was carried out, while my account exists; security-incident records for six (6) years; and certificates, so that they can still be verified later. The full schedule is set out in the Privacy Policy (§10).
5. My rights, and how I use them
I understand that I have the right to be informed, to access the personal data BATAS holds about me, to object to its processing, to have it corrected, to have it erased or blocked, to obtain it in a portable electronic format, to be indemnified for damage caused by its misuse, to be notified of a personal data breach that affects me, and to complain to the National Privacy Commission. I understand that these rights, and how to exercise them — including the timelines BATAS must meet — are set out in the Privacy Policy (§11).
I can exercise any of them, and I can withdraw any consent I have given here, by writing to the Data Protection Officer at batas.org@gmail.com, or by using the settings in my account. I understand that withdrawing a consent the Service needs in order to work will mean that the corresponding part of the Service can no longer be provided to me, and that it will not affect the lawfulness of what was done before I withdrew.
6. Everything else I am confirming
- I have read, or have had the opportunity to read, the Terms of Use, the Privacy Policy, and this Data Privacy Consent, and I accept them.
- The information I am giving is true, accurate, and about me; I am not using another person’s name or email address, and I am not creating an account for someone else without authority.
- I am eighteen (18) years of age or older. If I am between thirteen and seventeen, I am using the Service with the consent and supervision of my parent or legal guardian, who has accepted these documents on my behalf, and whom BATAS may treat as the person who gave this consent.
- I understand that BATAS may decline to create an account, or may suspend or close one, where this consent cannot be relied on or where the information given is false.
- I understand that withdrawing consent does not by itself entitle me to a refund, and that the Refunds, Cancellation & Subscriptions Policy governs money.
