MANILA WATER COMPANY INC., PETITIONER, VS. HLURB BOARD OF COMMISSIONERS AND HOMEOWNERS OF PHASES 1, 2, 3, 4, 5, 6, 7 & 8, REP. BY THEIR PHASE HOMEOWNER REPRESENTATIVES PH.1: JES…

Decisions / Signed Resolutions FORMER TENTH DIVISION PERALTA, JR., E. B., J.:

PERALTA, JR., E. B., J.:

With respect to Our Decision on February 4, 2014, which affirmed the competencia of, and propriety in the resolution by, the HLURB over issues aired before it by some homeowners per an arrangement between petitioner and the homeowners’ association,[1] petitioner’s Motion for Reconsideration harped on the idea that principal respondent was devoid of authority thereon.

Yet, while We appreciate efforts by petitioner to challenge Our major disposition on a matter of substantive and procedural law, the Motion for Reconsideration was mute about the incremental observations which were expressed in this wise:

“But what about Presidential Decree No. 957 and Executive Order No. 648 which were both utilized by petitioner to suggest that the HLURB was not clothed with appropriate authority to entertain the Complaint below?

Suffice it to say that provisions of PD 957 inconsistent with Executive Order No. 648 were repealed accordingly by Section 13 of Executive Order No. 648. As initially underscored, the relevant law when the Complaint was filed on March 22, 2011 was Republic Act No. 9904, which, to repeat, permitted the HLURB to resolve inter-association controversies and conflicts per Section 20 (d) thereof.”[2]

ACCORDINGLY, inasmuch as petitioner’s current recourse was devoid of merit, We hereby DENY the subject Motion for Reconsideration.

SO ORDERED.

De Leon, M. M., Chairperson, and Cruz, S. C., JJ., concur.
