PEOPLE OF THE PHILIPPINES, PLAITIFF-APPELLEE, V. DANILO DIONISIO @ KULOT, ACCUSED-APPELLANT.
REYES, JR., J.C., J.:
On November 12, 2013, the Judicial Records Division of this Court reported that as of said date no Appellant’s Brief has yet been filed (Rollo, back of p. 17).
On December 3, 2013, this Court issued a Resolution (Rollo, p. 18), this time requiring the accused-appellant to show cause why the appeal should not be dismissed for failure to file the Appellant’s Brief and to submit said Brief within ten (10) days.
As per Letter Tracer (Rollo, p. 20), it was shown that this Court’s Resolution dated December 3, 2013 was received by accused-appellant on December 16, 2013. Hence, he had until December 26, 2013 to file his Brief.
However, as per CAMIS Verification (Rollo, back of p. 20), no Appellant’s Brief has yet been filed as of April 29, 2014.
For having failed to file the Appellant’s Brief within the extended period, which expired on December 26, 2013, We now consider the appeal ABANDONED. Accordingly, the instant appeal is DISMISSED pursuant to Section 8, Rule 124 of the Revised Rules of Criminal Procedure.
SO ORDERED.
