FIRST SOVEREIGN ASSET MANAGEMENT (SPV-AMC), INC., AS SUCCESSOR-IN-INTEREST OF THE MANILA BANKING CORPORATION, PETITIONER, VS. SPOUSES FELIX TEE JATAP AND TERESITA JATAP, RESPOND…
CORALES, J.:
WHEREFORE, the Petition is DISMISSED. The September 30, 2011 Decision and December 19, 2011 Order of the Office of the President in O.P. Case No. 08-G-241 are hereby AFFIRMED.
However, no cogent reason appears for the reconsideration sought. Furthermore, in view of petitioner’s plea of grave injustice resulting from Our disposition of this case, We note that the April 4, 2003 Decision subject hereof includes an express directive for the payment of any outstanding balance on the loan owed to petitioner, as well as for the reimbursement of any amount already paid by petitioner to respondents herein.[3] Thus petitioner is not left without recourse and may yet enforce its rights through the proper remedies.
WHEREFORE, the Motion for Reconsideration is DENIED for lack of merit.
SO ORDERED.
