ADVERTISING ASSOCIATES, INC., FRANK ABUEVA AND EDGAR MENDOZA, PETITIONERS, VS. NATIONAL LABOR RELATIONS COMMISSION, JACQUELITO C. SONAJO AND WILFREDO SATUNERO, RESPONDENTS.
CORALES, J.:
WHEREFORE, the instant petition for certiorari is GRANTED. The November 21, 2011 Decision and January 31, 2012 Resolution of the National Labor Relations Commission are hereby SET ASIDE. The June 21, 2011 Decision of the Labor Arbiter is REINSTATED but with MODIFICATION. As modified, the P30,000.00 nominal damages to Jacquelito C. Sonajo and Wilfredo Satunero are hereby deleted. All other aspects of the Labor Arbiter’s Decision stand.
On December 4, 2013, private respondents filed a Motion for Reconsideration[2] of Our Decision, while petitioners filed their Comment[3] on January 22, 2014.
A perusal of the motion for reconsideration shows that the arguments raised therein are mere rehash of those already considered and passed upon by this Court. Furthermore, no new issues have been presented to justify the reversal or modification of Our Decision.
WHEREFORE, the motion for reconsideration is hereby DENIED for lack of merit.
SO ORDERED.
