This is a Petition for Certiorari[1] under Rule 65 of the Rules of Court seeking to annul the September 19, 2012[2] and March 4, 2013[3] Omnibus Orders of the Regional Trial Court (RTC), Branch 256, Muntinlupa City in LRC Case No. 11-041 entitled “In Re: Petition for Issuance of Writ of Possession Under Act No. 3135, As Amended, Over the Property Covered by Transfer Certificate of Title No. 79381 Registered in the Name of Sps. La Verne G. Malit and Medina Ruedas Malit, Banco De Oro Unibank, Inc., Petitioner.” The first assailed Order denied petitioners’ Motion to Dismiss, while the second questioned Order denied, among others, the Motion for Partial Reconsideration and Motion to Expunge Multiple Petitions.

On June 17, 2014, petitioners filed a Motion to Withdraw Petition,[4] informing the Court that they have already reached a settlement with private respondent as regards the property subject of the present petition. Finding the Motion to Withdraw to be well-taken, the same is hereby GRANTED.
WHEREFORE, the instant Petition for Certiorari is considered WITHDRAWN and the case is deemed CLOSED and TERMINATED. Let entry of judgment be issued.
