EXCLUDING FROM THE OPERATION OF PROCLAMATION NO. 823 DATED JUNE 29, 1935, AND OPENING TO DISPOSITION UNDER THE PROVISIONS OF COMMONWEALTH ACT NO. 137, AS AMENDED, A PARCEL OF LA…
WHEREAS, petitions have been filed for the
release of one parcel of mineral land, located in the barrios Kan-Kahurao and
Kapulahan, municipality of Aroroy, Province of Masbate, Island of Masbate,
Philippines, from the Northern Masbate Forest Reserve established under
Proclamation No 823 dated June 29,1935;
WHEREAS, according to the findings of the
Director of Mines, concurred in by the Secretary of Agriculture and Natural
Resources, the said parcel of land included in the Northern Masbate Forest
Reserve appears to be mineralized; and
WHEREAS, under the provisions of section 14 of
Commonwealth Act No. 137, otherwise known as the Mining Act, lands within
reservations established for purposes other than mining, which, after such
reservation is made, are found to be more valuable for their mineral contents
than for the purpose for which the reservation was made, may be withdrawn from
such reservations by the President of the Philippines only with the concurrence
of the Congress of the Philippines;
NOW, THEREFORE, I, Elpidio Quirino, President of
the Philippines, by virtue of the powers vested in me by law, do hereby exclude
from the operation of Proclamation No. 823, dated June 29, 1935, and declare
open to disposition under the provisions of Commonwealth Act No. 137, otherwise
known as the Mining Act, as amended, that parcel of land situated in the
barrios of Kan-Kahurao and Kapulahan, municipality of Aroroy, Province of
Masbate, Island of Masbate, and described on plan No. Bsm-50-D, to wit:
“Beginning at corner marked 1 on plan Bsm-50-D
being N. 78° 30′ W., 12,112.78 meters, more or less, from triangulation point
Bagalihog, U.S.C. & G.S., Masbate, thence S. 60° 00′ W., 300.00 meters to
corner 2; thence S. 60° 00′ W., 300.00 meters to corner 3; thence S. 60° 00′
W., 300.00 meters to corner 4; thence N. 30° 00′ W., 300.00 meters to corner 5;
thence S. 60° 00′ W., 300.00 meters to corner 6; thence S. 60° 00′ W., 300.00
meters to corner 7; thence N. 30° 00′ W., 300.00 meters to corner 8; thence N.
30° 00′ W., 300.00 meters to corner 9; thence N. 30° 00′ W., 300.00 meters to
corner 10; thence N. 30° 00′ W., 300.00 meters to corner 11; thence N. 30° 00′

corner 1, the point of beginning.
Containing an area of 360.0000 hectares.
All corners are concrete monuments, 15 cm. x 15
cm. x 60 cm. long, except corner 3, which is marked X on boulder, 120 cm.
diameter.
Bounded in all directions by the Northern Masbate
Forest Reserve established under Executive Proclamation No. 823, dated June 29,
1935.
Bearings: True. Declination: 0°-25′
E.”
Date of Survey: January 2—February 4, 1948, by Crisanto M. Flores,
private land surveyor, under the supervision of Simon C. Dumaguing, deputy
mineral land surveyor.
The cutting, removal and disposition of the
timber and other forest products within the area in question shall be under the
supervision and control of the Bureau of Forestry, and at any time the said
land is abandoned and is certified by the Director of Mines that it is no
longer needed and useful for mining purposes, the same shall revert as part of
the Northern Masbate Forest Reserve.
Done in the City of Manila, this 17th day of May,
in the year of Our Lord, nineteen hundred and forty-eight, and of the
Independence of the Philippines, the second.
