STAVELLAN INTERNATIONAL CO., MIKAEL AVELLAN AND JULIANA JEANETTE ROMANO, PETITIONERS, V. VIRGILIO V. CAAG, CELCA CAAG AND THE NATIONAL LABOR RELATIONS COMMISSION (SIXTH DIVISION…
DIAMANTE, F. N., J.:
under Rule 65 of the 1997 Rules of Civil Procedure with Urgent Prayer
for Temporary Restraining Order (TRO) and/or Preliminary Injunction[2] filed by the petitioners of the Decision dated April 23, 2013[3] and Resolution dated June 10, 2013[4]
of public respondent National Labor Relations Commission (NLRC), Sixth
Division, in NLRC LAC No. 10-002813-12 (NLRC Case No. 12- 18557-11).
Subsequently, petitioners filed a Motion for Reconsideration dated December 13, 2013[5] to which no comment was filed thereto by the private respondents.
Petitioners urged Us to take a second look at Our Decision
stressing that this Court erred in not giving weight to the pieces of
documentary evidence they presented which showed that herein private
respondents were not employees of petitioner Stavellan International
Company.[6] Further, petitioners reiterated that they were able to establish by clear proof that private respondents abandoned their work.[7]
We resolve to deny the motion.
After a careful scrutiny of Our Decision and the rationale therefor, We
are ever more convinced of its legal logic and correctness. The core
issues raised by the petitioners were already carefully dissected,
analyzed and addressed by this Court, hence, We find no sufficient or
justifiable reason to disturb the same.
WHEREFORE, in light of the foregoing, the Motion for Reconsideration is hereby DENIED for lack of merit.
SO ORDERED.
