NATIONAL HOUSING AUTHORITY, PETITIONERS-APPELLEES, VS. JULIAN CORDERO, RESPONDENT-APPELLANT.
LANTION, J.A.C., J.:
On 23 January 2014, Appellant filed a Motion[2] for extension of time to file his appellant’s brief, praying for additional forty-five (45) days, or until 9 March 2014, to file the same.
On 10 March 2014, Appellant filed another Motion[3] for extension of time to file his brief, asking for an additional period of thirty (30) days, or until 8 April 2014, to file the said pleading.
Instead of filing an appellant’s brief on 8 April 2014, Appellant once more filed a Motion[4] for extension of time, requesting for additional fifteen (15) days, or until 23 April 2014, to file his appellant’s brief.
On 26 May 2014, a Resolution[5] was issued by this Court granting Appellant’s Motions for extension of time to file his appellant’s brief, giving him until 23 April 2014 to submit the same “with warning against future extension.”
However, per Judicial Records Division Report[6] dated 17 July 2014, no appellant’s brief was filed by the Appellant.
Sec. 1 (e), Rule 50 of the Rules of Court provides:
SECTION 1. Grounds for dismissal of appeal. – An appeal may be dismissed by the Court of Appeals, on its own motion or on that of the appellee, on the following grounds:
(a) Failure of the record on appeal to show on its face that the appeal was taken within the period fixed by these Rules;
Considering Appellant’s failure to file his appellant’s brief despite the extensions of time granted to him, this Court considers the instant case ABANDONED and consequently DISMISSES the same.
SO ORDERED.
