PEOPLE OF THE PHILIPPINES, PLAINTIFF-APPELLEE, VS. JAIME AYOK Y VERGARA @ “JIMMY” AND FERLITO AYOK Y VERGARA @ “TOTO”, ACCUSED-APPELLANTS.

Decisions / Signed Resolutions July 31, 2014 FORMER EIGHT DIVISION GARCIA-FERNANDEZ, J.:

GARCIA-FERNANDEZ, J.:

This is a motion for reconsideration[1] filed by accused-appellants Jaime Ayok y Vergara @ “Jimmy” and Ferlito Ayok y Vergara @ “Toto” of the decision[2] of this Court promulgated on July 31, 2014. Plaintiff-appellee filed a comment[3] on the motion for reconsideration on October 7, 2014.

After examining the allegations in the instant motion for reconsideration, this Court finds the same to be mere reiteration of the matters raised in accused-appellants’ brief[4] dated September 10, 2009, that were studied, considered and passed upon by this Court in rendering the decision sought to be reconsidered. In other words, no new valid and justifiable reason was raised by accused-appellants to convince this Court to amend, much less, set aside its findings.

WHEREFORE, the motion for reconsideration is DENIED.

SO ORDERED.
