REX-ADB STORES AND SERVICES, INC., PETITIONER, VS. ISABEL KRISTIE C. SISON AND HON. ELIZABETH L. BERDAL OF THE REGIONAL TRIAL COURT, BRANCH 47, URDANETA CITY, RESPONDENTS.
DICDICAN, J.:
A cursory examination of the said petition discloses to us that it is fatally defective.
For one, it is not accompanied by a copy of the order subject thereof. Actually, what the petitioner seeks to be reversed or set aside by this Court is the order issued by Branch 47 of the RTC of the First Judicial Region stationed in Urdaneta City on October 21, 2014 in Civil Case No. U-8650 denying its motion to dismiss the said case. Very unfortunately, the petition filed in this case is not accompanied by a copy of the said court order, in disregard of the provision of the second paragraph of Section 1 of Rule 65 of the Rules of Court which explicitly requires that a petition for certiorari must be accompanied by a copy of the judgment or order subject thereof. Thus, this Court can not make heads nor tails about the petitioner’s case. Without a copy of the said order of the lower court, this Court can not make a determination of whether the lower court acted correctly or with grave abuse of discretion in issuing such order.
For another, the petition has not at all alleged specific acts that were purportedly committed by the lower court which constitute grave abuse of discretion. The allegations set forth in the petition appear to be just allegations of error in judgment supposedly committed by the lower court. In other words, the petition has not actually stated a valid cause of action for certiorari.
WHEREFORE, in view of the foregoing premises, we hereby DISMISS outright the petition filed in this case.
SO ORDERED.
