URIEL ORTEZA, JR., PETITIONER, VS. WILHELMSEN-SMITH BELL MANNING INC./ WILHELMSEN SHIP MANAGEMENT LTD., FAUSTO R. PREYSLER AND ANTONIO LADERA III, RESPONDENTS.
BRUSELAS, JR. J.:
Orteza contends that he should be entitled to full disability benefits under the Philippine Overseas Employment Administration-Standard Employment Contract (POEA-SEC). According to him, his injury, which was caused by playing basketball with fellow crewmates while on board the vessel, is compensable. He further asserts that the basketball game was allowed by the captain of the vessel and was likewise a direct consequence of the mandated duty of the Principal/Employer/Master/Company to “provide a workplace conducive for the promotion and protection of the health of the seafarers in accordance with the standards and guidelines in Title 4 of the ILO Maritime Labor Convention, 2006.”
After a careful assessment of the above allegations and the arguments in support thereof, we find the same to be a mere rehash of the issues and arguments raised in the petition and which have already been passed upon in our Decision. Hence, we find no cogent reason to reverse, much less, modify our Decision.
WHEREFORE, the petitioner’s motion for reconsideration is DENIED.
IT IS SO ORDERED.
PJ Reyes, Jr., A.B. Chairperson and Gaerlan, JJ., concur.
* Wilhelmsen was erroneously spelled as Wilhemsem in the Petition.
