ABS-CBN CORPORATION, PETITIONER, VS. NATIONAL LABOR RELATIONS COMMISSION (FOURTH DIVISION) AND MA. CECILIA J. PABICO, RESPONDENT.

Decisions / Signed Resolutions FORMER FIRST DIVISION BRUSELAS, JR. J.:

BRUSELAS, JR. J.:

From our Decision of 03 September 2014, the private respondent filed a motion for reconsideration to which the petitioner submitted a comment/opposition.

The private respondent asserts that the facts of this case had already been settled when the 15 August 2012 decision of the NLRC had become final and executory; that she could not be dismissed on the ground of loss of trust and confidence because her failure to report the VREA received was not work-related; and that the petitioner failed to adduce evidence to show that her dismissal was for a just cause.

Since the Court had already passed upon these arguments in the decision sought to be reconsidered, and the motion fails to disclose any other new, substantial argument that would warrant a reversal or modification of our earlier decision, the private respondent’s’ motion for reconsideration must fail for the same reasons stated in our earlier decision.

ACCORDINGLY, the private respondent’s motion for reconsideration is DENIED for lack of merit.

IT IS SO ORDERED.
