TERESITA M. TORRES, PETITIONER, VS. GILBERT PANABANG AND PEOPLE OF THE PHILIPPINES, RESPONDENTS.

Decisions / Signed Resolutions FORMER FIFTH DIVISION CARANDANG, J.:

CARANDANG, J.:

Before the Court is this Motion for Reconsideration filed by petitioner Teresita M. Torres praying for the reversal of this Court’s Decision of April 30, 2006, which dismissed her Petition for Review. However, a judicious reading of the arguments raised therein will readily reveal that they are mere rehash of petitioner’s previous arguments which had already been considered and passed upon by the Court when it promulgated its Decision. The facts of the case clearly show that petitioner was an accommodation party. She issued the check even without receiving any valuable consideration for the purpose of enabling her husband to obtain credit or to pay for the share of her husband in the business venture which private respondent had advanced.

WHEREFORE, in view of the foregoing, petitioners Motion for Reconsideration is DENIED for lack of merit.

SO ORDERED.
