TOP STAR SECURITY SERVICES CORPORATION,a PETITIONER, VS. NATIONAL LABOR RELATIONS COMMISSION AND ISAGANI O. FRANCISCO, RESPONDENTS.

On May 21, 2014, Petitioner Top Star Security Services Corporation, in its motion,^[1] prays for the dismissal of the petition in view of the amicable settlement between the parties as shown in the Compromise Agreement dated May 8, 2014,^[2] duly executed by them before the Labor Arbiter. Its full text reads as follows:

  COMPROMISE AGREEMENT
  Full Satisfaction of Judgment Award 

KNOW ALL MEN BY THESE PRESENTS: 

I, ISAGANI O. FRANCISCO, of legal age, with residence aaddress at Brgy. 171 Viola Crystal Phase 3, Bagombong, Caloocan City, NCR, in consideration of the amount of One Hundred Thousand (Php100,000.00) Pesos, in cash, receipt of which is acknowledged in full and complete satisfaction of my monetary judgment award against Top Star Security Services Corp. the (Company) pursuant to the decision of the above-entitled case do hereby voluntarily, freely, release, ABSOLVE the respondent company and its officers, and execute a waiver, release and quitclaim of any and all of my claims, causes of action now, existing and in the future against the company, its officers and members of the Board of Directors, whether civil, criminal or administrative, from any and all claims, liabilities, whatsoever which includes, but are not limited to any demand for salaries,/wages, 13th month pay, separation pay and or retirement pay, cash conversion of accumulated leave credits, or other benefits under existing law or any other similaw agreement or plan. The parties also agreed that the Certiorari Case with CA-G.R. SP. No. 134488 filed by Top Star Security Services Corp against Isagani Francisco at the Court of Appeals be dismissed in view of this compromise agreement. 

I further declare that I have fully read and understood the contents of this instrument and that I have signed the same freely and voluntarily and with full knowledge of my rights.

Settlements of this kind are highly encouraged and accepted. ACCORDINGLY, the Petition for Certiorari is hereby DISMISSED.
