SPOUSES JULIUS DEL ROSARIO AND REYLIN DEL ROSARIO, PETITIONERS, VS. HON. GIL G. BOLLOZOS, PRESIDING JUDGE OF THE REGIONAL TRIAL COURT (RTC), BRANCH 21, CAGAYAN DE ORO CITY, ELIZ…

Decisions / Signed Resolutions May 21, 2014 TWENTY-FIRST DIVISION SINGH, J.:

SINGH, J.:

In a Resolution[1] dated May 21, 2014, the above-captioned petition was dismissed due to procedural infirmities. On July 7, 2014, petitioners seasonably filed a Motion for Reconsideration with Prayer to Admit Amended Petition, and Payment of Deficiency in Docket and Other Legal Fees,[2] seeking the liberality of this Court and praying that their petition be given due course.

Considering that petitioners have rectified the procedural defects cited as grounds for the dismissal of their petition and to afford the parties the amplest opportunity to present their case in the interest of substantial justice, the present motion is GRANTED. Accordingly, the May 21, 2014 Resolution is hereby RECONSIDERED and the petition is REINSTATED.

Private respondents are directed to file a Comment (not a motion to dismiss) on the petition within ten (10) days from receipt hereof.

In the meantime, the Cash Division of this Court is DIRECTED to RETURN to petitioners or counsel the amount of Five Hundred Thirty Pesos (P530.00) representing excess in the payment of the docket fees.

SO ORDERED.

Borja, (Chairman), and Badelles, JJ., concur.
