LLOYD LABORATORIES, INC., INNOGENPHARMA GROUP, INC. AND DR. LLOYD D. BALAJADIA, PETITIONERS, VS. HONORABLE REYNALDO B. DAWAY, IN HIS OFFICIAL CAPACITY AS PRESIDING JUDGE OF THE …
Decisions / Signed Resolutions January 15, 2014 SPECIAL SIXTH DIVISION ABDULWAHID, J.:
ABDULWAHID, J.:
A perusal of the petition reveals that no motion for reconsideration of the assailed Order[1] dated January 15, 2014 was filed with the Regional Trial Court (RTC), Branch 90, Quezon City, prior to the filing of the petition for certiorari with this Court. This is contrary to the rule that a motion for reconsideration is indispensable before resorting to the special civil action for certiorari to afford the court or tribunal the opportunity to correct its error, if any.[2]
*Vice J. R.F. Barza, who is on leave, per Office Order No. 155-14-RSF dated April 22, 2014.
WHEREFORE, the petition for certiorari is DISMISSED outright for non-compliance with the Rules.
SO ORDERED.
