AAA IMPORT & EXPORT CORP., ARTHUR M. TAN, PETITIONERS, VS. NATIONAL LABOR RELATIONS COMMISSION, LILIBETH M. RECTO AND RICKY M. MANGUERRA, RESPONDENTS.
REYES-CARPIO, A., J.:
The case was referred to the Philippine Mediation Center of the Court of Appeals (PMC-CA) in order to explore the possibility of an amicable settlement[4] and pursuant to the Mediator’s Report,[5] dated September 17, 2014, the parties were able to compromise. Pursuant thereto, this Court issued a Resolution,[6] dated October 10, 2014, the pertinent portion of which reads:
“Considering the submission of the Mediator’s Report with attached Kasunduan ng Pagtanggap at Kabayaran executed by respondents in December 4, 2013 do not clearly show petitioners’ intention regarding this case, petitioners are directed to inform this Court within five (5) days from notice of its intentions and to file the necessary motion relative thereto.”
The Philippine Mediation Center was also directed to submit a complete copy of the compromise agreement executed by the respondents. In compliance with the aforequoted Resolution, counsel for petitioners filed the corresponding Motion to Withdraw Petition[7] and subsequently, the written conformity of petitioner to the withdrawal of the petition. The PMC-CA also submitted the required copy of the Mediator’s Report of the compromise agreement.
ACCORDINGLY, the Motion to Withdraw Petition is GRANTED. The copy of the Mediator’s Report of the Kasunduan ng Pagtanggap at Kabayaran by Lilibeth Recto and Ricky M. Manguerra are NOTED. The instant case is hereby considered CLOSED and TERMINATED.
SO ORDERED.
