HEIRS OF LINA J. EBARLE, NAMELY: MYRNA JOY ARELLANO, BEN HUR ARELLANO, GEOFFREY ARELLANO AND CYRIL LYN ARELLANO CLEMENA, PLAINTIFFS-APPELLANTS, VS. NENITA C. SIA, LILIAN EBARLE …
FRANCISCO, J.:
On 29 January 2014 the parties have executed a Compromise Agreement[3]. A scrutiny of the agreement reveals that it was signed by all the parties.
This Court, thus, APPROVES the Compromise Agreement as it is not contrary to law, morals, public policy and public order.
In First Intramuros BF Condominium Corporation and Maxy Abad v. NLRC and Nancy Dingayan Quimpo,[4] the Supreme Court held:
“xxx xxx xxx, the law not merely authorizes, but even encourages, the amicable settlement of disputes between parties (Art. 2029, Civil Code), and it does not limit such compromise to cases about to be filed but also to cases already pending in court.”
WHEREFORE, the Compromise Agreement reached by the parties is hereby APPROVED and the instant appeal ORDERED DISMISSED.
SO ORDERED.
