VIVIAN UY, PETITIONER, VS. MARICEL RANCE, ET. AL., RESPONDENTS.

Decisions / Signed Resolutions December 29, 2014 SPECIAL SIXTEENTH DIVISION BUESER, J.:

BUESER, J.:

A perusal of the instant petition filed under Rule 65 of the Rules of Court reveals that the same is defective based on the following grounds, to wit:

a. The instant petition was prematurely filed since petitioner filed a Motion for Reconsideration on the assailed National Labor Relations Commission (“NLRC” for brevity) dated 29 December 2014 and it does not appear that the same was resolved by the NLRC[1];

b. There is no proof of service nor an affidavit of service of the instant petition on adverse parties and or the NLRC;

c. The assailed NLRC Resolution attached therein is a mere “Certified Photocopy” and is neither a duplicate original nor a certified true copy;

d. Herein parties respective addresses were not indicated; and

e. The annexes attached to the instant petition are unmarked.

Thus, pursuant to Section 1, Rule 65 in relation to Section 3, Rule 46 of the Rules of Court non compliance with any of the requisites provided therein will result in the dismissal of the petition.

WHEREFORE, in view of the foregoing, the instant petition is hereby DISMISSED.

IT IS SO ORDERED.
