JEBSENS MARITIME, INC., PETITIONER, VS. RAMON A. GALUTIRA, RESPONDENT.

Decisions / Signed Resolutions FIRST DIVISION BRUSELAS, JR. J.:

BRUSELAS, JR. J.:

Before us is a petition for review under Rule 43 which seeks to reverse and set aside the Decision[1] of the Office of the Panel of Voluntary Arbitrators of the National Conciliation and Mediation Board (NCMB) NCR that ordered the petitioner Jebsens Maritime, Inc. to jointly and severally pay, together with Hapag-Lloyd Aktiengesellschaft, the respondent Ramon A. Galutira the following amounts: 1.) US $ 60,000.00 representing disability benefits; and 2.) 10% of the total award by way of attorney’s fees.

On 21 October 2014, the Court directed the respondent to file a Comment to the Petition. Instead of filing a Comment, however, the respondent filed a Manifestation[2] stating that the parties have come to an agreement to settle the case amicably; that the petitioner has offered and respondent, thru counsel, has accepted, settlement of the case in exchange for payment in the amount of Sixty Thousand US Dollars (US $ 60,000.00). The Compromise Agreement[3] was executed on 30 October 2014. The respondent likewise submitted a Release of All Rights[4] (Pagpapaubaya ng Lahat ng Karapatan)[5] and a Joint Motion to Dismiss[6] had been submitted on the ground that the parties have entered into a compromise agreement and a final amicable settlement.

The petitioner, for its part, filed a Manifestation and Motion[7] of the above-mentioned final settlement of the respondent’s claims and moved for the withdrawal of the petition.

WHEREFORE, the parties’ Manifestations are duly NOTED and the petitioner’s Motion is GRANTED. The petition is deemed withdrawn. Consequently, this case is considered CLOSED and TERMINATED.

IT IS SO ORDERED.

Reyes, Jr., PJ., (Chairperson) and Gaerlan, JJ., concur.
