On October 29, 2013, this Court required the defendant-appellant to file three (3) legibly typewritten, mimeographed or printed copies of the Appellant’s Brief with legible copies of the assailed Decision of the trial court, pursuant to Rule 44, Section 7 of the 1997 Rules of Civil Procedure, within forty five (45) days from receipt of notice (Rollo, p. 16).
As per Registry Return Receipt (Rollo, back of p. 16) and Tracer (Rollo, p. 19), defendant-appellant received a copy of the above-quoted Notice on November 15, 2013, thus giving her up to December 30, 2013 within which to file the Appellant’s Brief.
As per CMIS Verification Report dated February 26, 2014, no Appellant’s Brief has been filed as of even date (Rollo, back of p. 21).
Accordingly, for failure to file the Appellant’s Brief within the reglementary period, the Appeal is now deemed ABANDONED and thus ordered DISMISSED pursuant to Section 1(e), Rule 50 of the 1997 Rules of Civil Procedure.
SO ORDERED.
