KEPCO ILIJAN CORPORATION, PETITIONER, VS. NATIONAL LABOR RELATIONS COMMISSION AND RONALD GARCIA, RESPONDENTS-APPELLEES.
SADANG, J.:
1. On March 15, 2012, petitioner filed a Petition for review Under Rule 65 seeking the reversal of the resolution and decision of the National Labor Relations Commission (NLRC), copies of which were attached in the Petition filed;
2 Upon the submission of the parties of their respective memorandum, on July 26, 2013, the Honorable Court issued an order stating that the issue is now subject of resolution .
3. A Writ of Execution against the cash bond posted by the petitioner has also been executed in favor of the complainantt and, therefore, any claims he may have against the petitioner were already satisfied.
4. While not admitting any legal responsibility, petitioner, taking into consideration the personal condition of private respondent, as well as the fact that while the NLRC Rules of Procedure recognizes the issuance of an Order of Restitution in case of a reversal, the possibility of enforcing such order is very slim in light of the private respondent’s financial circumstances.
5. So as not to unnecessarily burden the Honorable Court in deciding this case, the petitioner seeks for the withdrawal of the instant Petition for Review and that the issue is now closed and terminated.
Finding the said Motion for Leave to Withdraw Petition dated August 11, 2014 to be meritorious, the same is hereby GRANTED.
WHEREFORE, the instant Petition is hereby WITHDRAWN and consequently ordered CLOSED and TERMINATED.
SO ORDERED.
