DEMURRER ; CONSTRUCTION OF PENAL STATUTES.—Appeal from an order of the Court of First Instance of Isabela sustaining a demurrer to the information filed by the provincial fiscal. McCabe, J.
The question raised by the demurrer is identical with that raised in United States vs. El Ohino Cuna (alias Sy Conco) (page 241, supra) and is decided on the same principles. Order reversed and case remanded for further proceedings.
