This court having regularly acquired jurisdiction for
the trial of the above-entitled cause submitted by both parties for
decision,after consideration thereof by the Court upon the record, its
decision and order for judgment having been filed on the 28th day of
July, A. D. nineteen hundred and thirty-four;
By virtue thereof it is hereby adjudged and decreed
that so much of the judgment appealed from as dismissed the complaint of
the plaintiff is affirmed, and so much of the judgment as allowed the
counterclaim of the defendant is reversed, with the result that neither
party recover anything from the other, without special pronouncement as
to costs in either instance.
