SAN RAFAEL UNITY, INC. AND WASHING GO, PETITIONERS, VS. NATIONAL LABOR RELATIONS COMMISSION AND MARTIN GENOVIA,

Decisions / Signed Resolutions January 9, 2009 NINTH DIVISION DICDICAN, J.:

DICDICAN, J.:

It appears that the petition filed in this case has been pending in this Court for a long time already because the private respondent has not been duly served with a copy of the petition as well as with a copy of the resolution of this Court directing him to file a comment on the petition. In effect, this Court has not acquired jurisdiction over the person of the private respondent. This Court had directed the petitioners to furnish it with sufficient or better address of the private respondent, as per resolutions promulgated on January 9, 2009 and March 5, 2009, but the petitioners had failed to do so. So it was that, on March 31, 2009, this Court promulgated a resolution archiving this case. Since then, however, nothing transpired as the petitioners seemed to have done nothing to let this case move.

On February 11, 2015, the Archives Section of the JRD of this Court reported formally to the Clerk of this Court the fact that it has not received any information from the petitioners about the sufficient address of the private respondent where he can be served with this Court’s resolutions and processes. On February 18, 2015, the Clerk of this Court indorsed to us the said report for appropriate action.

Apparently, we can not let this case be pending with this Court forever. This Court can not render a decision on the petitioners’ petition because no jurisdiction has been acquired by the Court over the person of the private respondent. The petitioners had not duly complied with this Court’s resolutions promulgated on January 9, 2009 and March 5, 2009. Consequently, we have no other choice but to dismiss this case.

WHEREFORE, in view of all the foregoing premises, the petition filed in this case is hereby DISMISSED.

SO ORDERED.
