STA. ANA AVILA CORPORATION, PLAINTIFF-APPELLEE, VS. PHILIPPINE SEVEN CORPORATION, DEFENDANT-APPELLANT.
DIAMANTE, J.:
Subsequently, or on November 25, 2013, defendant-appellant filed a Motion for Reconsideration[3] of the above-cited Decision. On July 22, 2014, plaintiff-appellee filed a Motion for Leave to Admit Comment/Opposition (to the defendant-appellant’s Motion for Reconsideration).[4] This Motion was admitted, over defendant-appellant’s Comment/Opposition,[5] in a Minute Resolution issued by this Court on August 7, 2014.[6]
Defendant-appellant urged Us to take a second look at Our Decision stressing that this Court erred in holding that its unilateral pre-termination of the lease contract was not justified.[7] It likewise stressed that plaintiff-appellee had no legal basis to collect any rentals for the unexpired portion of the said lease contract.[8]
We resolve to deny the motion.
After a careful scrutiny of Our Decision and the rationale therefor, We are ever more convinced of its legal logic and correctness. The core issues raised by defendant-appellant are but a mere rehash of the issues already dissected, analyzed and passed upon adequately by this Court, hence, We find no sufficient or justifiable reason to disturb the same.
WHEREFORE, in light of the foregoing, the Motion for Reconsideration is hereby DENIED for lack of merit.
SO ORDERED.
