UNITED INDEPENDENT LABOR UNIONS OF THE PHILIPPINES (UNILUP) AND ITS MEMBERS NAMELY: JUAN COLLAO, ERIBERTO R. VIÑAS, FLORENCIO L. SIBUYO, JR., MELCHOR C. LUMIDAO, AUGUSTO O. PAST…
DIAMANTE, J.:
Subsequently, petitioners filed a Motion for Reconsideration dated March 24, 2014[5] of the above-cited Decision to which respondents filed their Comment/Opposition thereto dated July 10, 2014.[6]
Petitioners urged Us to take a second look at Our Decision stressing that this Court had shown bias and patently erred in holding that their money claims had already prescribed and in finding that their claim for overtime pay, holiday pay, premium pay for holiday, service incentive leave and 13th month pay were likewise barred.[7] Petitioners likewise insisted that the private respondents were guilty of unfair labor practice.[8]
We resolve to deny the motion.
After a careful scrutiny of Our Decision and the rationale therefor, We are ever more convinced of its legal logic and correctness. The core issues raised by the petitioners are but a mere rehash of the issues already dissected, analyzed and passed upon adequately by this Court, hence, We find no sufficient or justifiable reason to disturb the same.
WHEREFORE, in light of the foregoing, the Motion for Reconsideration is hereby DENIED for lack of merit.
SO ORDERED.
