noting private respondent Napoleon B. Dictado’s Manifestation stating that he and petitioners came to an amicable settlement of the case in the NLRC; and

directing petitioners to inform this Court within five (5) days from notice how they wish to proceed with the petition in so far as the other respondents are concerned before this Court acts on the Mediator’s Report filed on April 10, 2014 submitting petitioner company’s Manifestation which was signed by petitioner Pacita B. Nasam praying for the termination/dismissal of the case pursuant to the settlement between petitioner company and respondent Napoleon B. Dictado before the Labor Arbiter.

In compliance with the aforesaid directive, a Manifestation was filed by petitioner company signed by petitioner Pacita B. Nasam praying for the termination of the case also against respondents Prosperity Group of Companies and Emerson Go.
The record shows that no comment to the petition has been filed by the said respondents.
WHEREFORE, the foregoing considered, petitioners’ Manifestation praying for the termination/dismissal of the case pursuant to the settlement between petitioners and respondent Napoleon B. Dictado before the Labor Arbiter as well as their subsequent manifestation also praying for the termination/dismissal of the case against respondents Prosperity Group of Companies and Emerson Go are both hereby GRANTED.
Accordingly, the instant petition is hereby DISMISSED against all the respondents.
The case is now declared CLOSED and TERMINATED .
