PHILIPPINE PORTS AUTHORITY, PETITIONER, VS. NATIONAL LABOR RELATIONS COMMISSION, 8TH DIVISION, CAGAYAN DE ORO CITY AND JESUS J. PASQUIN AND GIDEON L. PASAOL, RESPONDENTS.

Decisions / Signed Resolutions February 25, 2014 TWENTY-THIRD DIVISION CONTRERAS, J.:

CONTRERAS, J.:

Addressed here is petitioner’s Motion for Reconsideration[1] seeking the reversal of Our Decision[2] dated February 25, 2014, the dispositive portion[3] of which reads:

WHEREFORE, instant Petition for Certiorari is hereby DISMISSED for lack of merit. The assailed Resolutions dated May 31, 2010 and September 30, 2010 of the National Labor Relations Commission, Eight[h] Division (Formerly Fifth Division), Cagayan de Oro City are Hereby AFFIRMED in toto.

SO ORDERED.

Private respondents duly filed a Comment.[4]

A careful study of petitioner’s motion for reconsideration reveals that the allegations therein are mere rehash of the arguments raised in the pleadings, which were already considered and passed upon in rendering the assailed decision. Petitioner failed to raise new substantial matter nor present compelling reason to warrant a reversal of the assailed decision. Hence, the motion for reconsideration is hereby DENIED.

SO ORDERED.
