FOREST HILLS ACADEMY / NAOMI CABALUNA, ADMINISTRATOR, PETITIONER, VS. NATIONAL LABOR RELATIONS COMMISSION (FIFTH DIVISION, CAGAYAN DE ORO CITY), LYDIA MILLAMA AND INDALINA C. AL…

Decisions / Signed Resolutions February 19, 2013 SPECIAL FORMER TWENTY-SECOND DIVISION FRANCISCO, J.:

FRANCISCO, J.:

This resolves the Motion for Reconsideration[1] filed by the petitioners assailing our Resolution[2] dated 19 February 2013. The assailed Resolution states:

Accordingly, this Court RECONSIDERS and SETS ASIDE the 26 September 2012 Resolution. The cash bond in the amount of Php 418,044.00 deposited by petitioner Forest Hills Academy / Naomi Cabaluna, evidenced by Official Receipt No. 2272284, is ordered released to the private respondents, Lydia Millama and Indalina Alvero.[3]

The petitioners’ Motion for Reconsideration fails to state any ground to convince this Court to reconsider and set aside its 19 February 2013 Resolution.

Again, it bears reiterating that the parties had already come to an agreement for the release of the amount deposited with this Court to cover partially the judgment in favor of the private respondents.

It was pursuant to this agreement that the NLRC ordered its Branch Sheriff to coordinate with this Court for the release of the said cash bond in satisfaction of the partial judgment in favor of the private respondents.

Accordingly, the Motion for Reconsideration filed by the petitioner is hereby DENIED.

SO ORDERED.

Camello, J., Ch., and Badelles, JJ., concur.
