PEOPLE OF THE PHILIPPINES, PLAINTIFF-APPELLEE, VS. RONNIE VEDASTO Y BARON, ACCUSED-APPELLANT.

Decisions / Signed Resolutions May 15, 2014 FORMER FIFTH DIVISION CARANDANG, J.:

CARANDANG, J.:

We find no justifiable reason to reverse or set aside Our Decision dated May 15, 2014 affirming accused-appellant’s conviction.

The allegations in the Motion for Reconsideration[1] pertaining to the inconsistencies of the testimonies of the prosecution’s witnesses are not new. This issue was presented as one of his arguments in the appellant’s brief and already considered and passed upon in Our decision. Besides, the inconsistencies are too trivial and inconsequential to warrant the reversal of his conviction. We cannot depart from Our ruling that Gilbert witnessed the taking of the laptop by the accused.

ACCORDINGLY, accused-appellant’s Motion for Reconsideration of Our Decision dated May 15, 2014 is DENIED.

SO ORDERED.

Gonzales-Sison and Sorongon, JJ., concur.
