CENTRAL MINDANAO UNIVERSITY, REPRESENTED BY ITS PRESIDENT MARIA LUISA R. SOLIVEN, PETITIONER, VS. THE HONORABLE JUDGE JOSEFINA GENTILES BACAL, IN HER CAPACITY AS PRESIDING JUDGE…

Decisions / Signed Resolutions January 13, 2014 TWENTY-SECOND DIVISION CAMELLO, J.:

CAMELLO, J.:

On 27 August 2014, we issued a Minute Resolution declaring the instant petition submitted for decision.

On 29 September 2014, petitioner, through the Office of the Solicitor General (OSG), filed a Manifestation and Motion to Withdraw Petition, alleging that public respondent already dismissed Civil Case No. 4026-09 in an Order dated 13 January 2014 for failure of private respondent to appear in the preliminary conference despite due notice. With no motion for reconsideration filed despite receipt of the subject Order on 17 February 2014, the Order of dismissal became final as evidenced by the Certificate of Finality dated 22 September 2014. As a result, the cause of action of this petition has been rendered moot and academic. Thus, petitioner moves to withdraw the petition. Attached to the motion are copies of the Order dated 13 January 2014 and Certificate of Finality dated 22 September 2014.

We find the motion in order, hence, we grant the same.

FOR THIS REASON, the Manifestation and Motion to Withdraw Petition is GRANTED. The instant petition is deemed WITHDRAWN and TERMINATED.

In accordance with Section 1(b), Rule VII of the 2009 Internal Rules of the Court of Appeals (IRCA), the Division Clerk of Court is DIRECTED to immediately make an Entry of Judgment.

SO ORDERED.

Inting, and Perez, JJ., concur.
