SPS. EMERSON AND ANGELITA M. SUDARIO, PETITIONERS, VS. JUANITA M. CABAL, RESPONDENT.
BALTAZAR-PADILLA, J.:
“WHEREFORE, premises considered, petitioners’ prayer for issuance of a temporary restraining order and/or writ of preliminary injunction is DENIED.
To give the parties a final chance to amicably settle their dispute, this case is hereby referred to the PMC-CA for mediation.
SO ORDERED.’[1]
Dissatisfied therewith, petitioners filed a Motion for Reconsideration of the said Resolution. Comment/Opposition to the Motion was filed by respondent.
A judicious evaluation of the said Motion discloses that no convincing and justifiable reason was advanced by the movant that would convince US to modify, alter, much less, reverse the questioned Resolution. The allegations and arguments therein embodied had already been weighed and considered by US when the said Resolution was issued.
WHEREFORE, on account of the foregoing, the Motion for Reconsideration of petitioners is hereby DENIED.
The case is referred anew to the Philippine Mediation Center-Court of Appeals.
SO ORDERED.
Tijam, (Chairperson), and Reyes-Carpio, JJ., concur.
