Decisions / Signed Resolutions FORMER FIRST DIVISION BRUSELAS, JR. J.:

BRUSELAS, JR. J.:

From our Decision of 04 September 2014, the appellees filed a partial motion for reconsideration of our ruling that set aside the trial court’s dismissal of the complaint below on the ground of res judicata. The appellees contend that all elements of res judicata exist and so, the complaint below was correctly dismissed based on such ground.

We note that this argument had already been raised in the appellees’ brief and which had been thoroughly addressed in the decision sought to be reconsidered. There being no other new, substantial argument that would warrant a reversal or modification of our earlier decision, the appellees’ motion for reconsideration must fail for the same reasons stated in our earlier decision.

ACCORDINGLY, the appellees’ motion for reconsideration is DENIED for lack of merit.

IT IS SO ORDERED.
