PEOPLE OF THE PHILIPPINES, PLAINTIFF-APPELLEE, VS. ROLANDO SANTOS Y ZARAGOZA, ACCUSED-APPELLANT.

Decisions / Signed Resolutions August 6, 2014 FORMER FOURTH DIVISION CARANDANG, J.:

CARANDANG, J.:

We find no persuasive grounds or substantial bases to reconsider, reverse or set aside Our Decision dated 6 August 2014. The arguments in the Motion for Partial Reconsideration are merely rehash of the previous arguments which this Court had duly considered and thoroughly discussed in the assailed Decision.

The case of People vs. Jaime Gatlabayan[1] cited in the Motion is not in all fours with the instant case because in that case, there were large gaps in the chain of custody of the confiscated drugs. That situation is not extant in this case because the prosecution was able to comply with the chain of custody rule in the handling of the seized and drug paraphernalia from the time it was found by SI Saul in the person of the accused up to the time it was presented in the court a quo.

In view thereof, the instant Motion for Reconsideration is hereby denied for lack of merit.

SO ORDERED.

Gonzales-Sison, and Sorongon, JJ., concur.
