HON. NONNATUS CAESAR R. ROJAS, IN HIS CAPACITY AS REGIONAL PROSECUTOR, REGIONAL PROSECUTION OFFICE I, AND JOSELITO CARIAGA, RESPONDENTS.

Decisions / Signed Resolutions March 21, 2014 SPECIAL SIXTH DIVISION ABDULWAHID, J.:

ABDULWAHID, J.:

Although petitioner Danilo Calivo Cariaga, through counsels, Atty. Oscar A. Corpuz, Jr. and Atty. Edgardo Y. Pascua, filed this petition for certiorari dated March 21, 2014 within sixty (60) days from receipt of the assailed January 16, 2014 Resolution of the Office of the Regional State Prosecution and complied with other requirements, the said petition suffers from some procedural infirmities which are valid grounds for dismissal of the case, to wit:

a) no motion for reconsideration of the assailed January 16, 2014 Resolution appeared to have been filed with the Department of Justice before the filing of the petition for review; b) there is no express assertion in the petition of that grave abuse of discretion which was committed by the public respondent; c) there are no copies of the pleadings filed before the Regional Prosecution Office (Region 1) attached to the petition; and d) certain portions of the petition are illegible.[1]

WHEREFORE, the petition for review in the above-entitled case is DISMISSED, for non-compliance with the Rules.

SO ORDERED.
