GLOBAL EQUITIES, INC., APPLICANT-APPELLEE, VS. REPUBLIC OF THE PHILIPPINES, OPPOSITOR-APPELLANT.
LOPEZ, J.:
In its motion, applicant-appellee prays that the case be remanded to the Municipal Trial Court in Cities Branch 2 to comply with the quantum of evidence required by the Republic of the Philippines, with the end in view of substantiating its ownership of the land. Applicant-appellee contends that a land registration case is essentially non-adversarial as the Government’s sole interest is to ensure that the persons in whose name the land is sought to be registered are indeed qualified under the law. Lastly, applicant-appellee claims that no private party has come forward to oppose the application for registration.[1]
The Republic, through the Office of the Solicitor General, filed its Manifestation[2] interposing no objection to the remand of the case, provided that applicant-appellee understands and accepts fully that it is willingly vacating and abandoning the judgment rendered in its favor.
WHEREFORE, the motion is GRANTED. The July 10, 2012 Decision of the Municipal Trial Court in Cities Branch 2 in LRC Case No. N-2004-143 is VACATED and the case is REMANDED for further proceedings. Consequently, this appeal is deemed CLOSED and TERMINATED.
SO ORDERED.
