On November 12, 2014, the Judicial Records Division (JRD) of this Court sent defendant-appellant High Quality Agricultural Development Corporation a Notice to File Appellant’s Brief[1] within forty-five (45) days from receipt thereof. Defendant-appellant corporation received the notice on November 25, 2014 while its counsel Atty. Allaine Arnolf A. Palomo received the same on November 26, 2014.[2]

Per JRD Report[3] dated February 11, 2015 no Appellant’s Brief has yet been filed by defendant-appellant corporation.
WHEREFORE, for failure of plaintiff-appellant High Quality Agricultural Development Corporation to file Appellant’s Brief, the instant appeal is hereby DISMISSED and considered ABANDONED pursuant to Section 1(e), Rule 50 of the Revised Rules of Court.
