Decisions / Signed Resolutions February 18, 2014 TENTH DIVISION VELOSO, J.:
VELOSO, J.:
On the strength of Section 1(h), Rule 50, Rules of Court, as amended, the Court is constrained to DISMISS the instant Petition for Certiorari[1] dated February 18, 2014, due to the failure of petitioner, through counsel, to comply without justifiable cause, with this Court’s Resolution[2] dated August 8, 2014.
[1] Rollo, p. 10.
Records show that in the aforementioned resolution, petitioner, through counsel, was directed to file her comment on respondents’ Manifestation and Motion dated June 26, 2014, within ten (10) days from notice.[3]
Per Registry Return Receipt No. MDS 375, Atty. Stanley R. Cabrera, petitioner’s counsel, received his copy of the subject resolution on “8-19-2014.”[4] Ten (10) days therefrom would have been August 29, 2014. The Court waited but no compliance was filed per Verification Report[5] dated November 4, 2014.
ACCORDINGLY, the instant petition is DISMISSED.
SO ORDERED.
Lantion, and Antonio-Valenzuela, JJ., concur.
