ELMER BALLIO AND FLORA LEGANIO, PLAINTIFFS,

Decisions / Signed Resolutions FORMER FIRST DIVISION BRUSELAS, JR. J.:

BRUSELAS, JR. J.:

We are confronted with the appellant’s motion for reconsideration reiterating that he is entitled to the 2-hectare land promised to him by the appellee Gabriel P. Keith, Sr. He also argues, for the first time, that he should be compensated for the substantial improvements he introduced on the land, he being a builder in good faith.

The issue of whether or not the appellant is entitled to the 2-hectare land was the meat of the appellant’s brief, and we find no cogent reason to revisit the same because it had been thoroughly addressed in the decision sought to be reconsidered.

The appellant’s claimed compensation as a builder in good faith deserves no merit. For one, this matter was neither raised in the complaint below nor in the appellant’s brief. For another, the complaint below was only for annulment of documents, recovenyance with damages.

Since the motion fails to disclose any other new, substantial argument that would warrant a reversal or modification of our earlier decision, the appellant’s motion for reconsideration must fail.

ACCORDINGLY, we DENY the appellant’s motion for reconsideration for lack of merit.

IT IS SO ORDERED.

PJ Reyes, Jr., Chairperson and Gaerlan, JJ., concur.
