RULE I

GENERAL  PROVISIONS

SECTION 1. – Title. – These rules and regulations shall be referred to as the Implementing Rules and Regulations (IRR) of Republic Act No. 12119 titled “An Act Establishing the Baguio City Sports High School and Appropriating Funds Therefor”.

SEC. 2. Declaration of Policy. – It is the declared policy of the State to promote physical education and encourage sports programs, league competitions, and amateur sports, including training for international competitions, to foster self-discipline, teamwork, and excellence for the development of a healthy and alert citizenry.

To this end, the State shall promote the sustained development of young Filipinos whose skills in the field of sports shall be encouraged and honed through education and specialized training programs.

It shall establish, maintain, and support a comprehensive and integrated system of education and training to encourage interest in sports among the youth, hone their athletic talents and skills, and promote the development of young athletes nationwide.

SEC. 3. Definition of Terms. – For purposes of this IRR, the following items are hereby defined:

a.
Act – refers to RA No. 12119, titled, “AN ACT ESTABLISHING THE BAGUIO CITY SPORTS  AND APPROPRIATING FUNDS THEREFOR.”;
b.
Establishment of a Public School – refers to the process of initiating, instituting, organizing, operating, conducting, and maintaining a new public school in a barangay, municipality, city, or province by the administrative authority of the respective Department of Education (DepEd) Regional Office;
c.
National Academy of Sports (NAS) – refers to the National Academy of Sports created under R.A. No. 11470. Its policies, guidelines, and criteria, whenever applicable, shall be the basis for the administration and operation of the Baguio City Sport High School;
d.
National Academy of Sports System (NAS System) – refers to the system, established under RA No. 11470, mandated to implement a quality and enhanced secondary education program, integrated with a special curriculum on sports which aims to develop the athletic skills and talents of students in world class sports facilities which are at par with international standards;
e.
Non-Teaching Personnel – refers to those occupying non-teaching positions, either on full time or part-time, whose primary duties and responsibilities contribute to the delivery of basic education services and achievement of agency outcomes, but neither involve nor directly support the actual conduct of teaching or delivery of instruction;
f.
RA No. 10533 – refers to “AN ACT ENHANCING THE PHILIPPINE BASIC EDUCATION SYSTEM BY STRENGTHENING ITS CURRICULUM AND INCREASING THE NUMBER OF YEARS FOR BASIC EDUCATION, APPROPRIATING FUNDS THEREFOR AND FOR OTHER PURPOSES,” otherwise known as the “Enhanced Basic Education Act of 2013”;
g.
RA No. 9155 – refers to “AN ACT INSTITUTING A FRAMEWORK OF GOVERNANCE FOR BASIC EDUCATION, ESTABLISHING AUTHORITY AND ACCOUNTABILITY, RENAMING THE DEPARTMENT OF EDUCATION, CULTURE AND SPORTS AS THE DEPARTMENT OF EDUCATION, AND FOR OTHER PURPOSES”, otherwise known as the “Governance of Basic Education Act of 2001”;
h.
Related-Teaching Personnel – refers to those whose primary duties and responsibilities contribute to the delivery of basic education services and achievement of agency outcomes, through the provision of direct support to teaching and the delivery of instruction, such as standard setting, policy and program formulation, research, and sector monitoring and evaluation.
i.
Sports High School  – refers to an enhanced secondary school offering a curriculum that has significant emphasis on the holistic development of student-athletes.
 
For purposes of this IRR, Sports High School shall refer to Baguio City Sports High School.
j.
Student-athlete – refers a student currently enrolled in the Sports High School who is a member of any of the school’s athletic teams or programs and who represents or has intentions of representing the school in an inter-school athletic program or competition. The student-athlete must be enrolled in at least a minimum full-time curricular program and must be in good standing to be eligible to represent the school in an inter-school athletic program or competition; or
k.
Teacher – refers to those occupying teaching positions directly engaged in teaching positions directly engaged in teaching or delivery of instruction, either on full-time or part-time basis, in the Baguio City Sports High School.


RULE II
ESTABLISHMENT OF SPORTS HIGH SCHOOL 
SECTION 4. Establishment of the Baguio City Sports High School. – There is hereby established in the City of Baguio a specialized public high school that shall offer sports focused education, to be known as the Baguio City Sports High School, herein referred to as the “Sports High School,” Provided that, the establishment of the Sport High School shall be consistent with the procedure laid down in relevant DepEd issuances, including DepEd Order No. 40, s. 2014, as amended.
The Sports High School shall be administered and supervised by DepEd, in close coordination with the Philippine Sports Commission (PSC) and the National Academy of Sports (NAS).
It shall be administered and operated in accordance with the policies, guidelines, and criteria to be issued by the NAS System Board of Trustees, pursuant to Section 8(a) of Republic Act No. 11470, or “The National Academy of Sports” law.

SEC. 5. Mandate. – The Sports High School shall implement a general secondary education, as prescribed by Republic Act No. 10533, to learners with considerable potential in sports. The curriculum shall have significant emphasis on developing the athletic skills of the learners through subjects pertaining to physical education and sports.

RULE III
CURRICULUM AND TEACHING
SEC. 6. Curriculum and Teaching. – The Sports High School shall implement a general secondary curriculum, as prescribed by RA 10533, with a special focus on sports based on the Special Program in Sports (SPS) curriculum and applicable sports development programs. In the development of the school curriculum, the Sports High School shall be guided by the following:

6.1
Adoption and Alignment of Curriculum. The Sports High School shall strictly adhere to the curriculum and program standards developed by DepEd, in consultation with the PSC, NAS, and other relevant government agencies.
6.2
Learning Delivery. The Sports High School shall integrate, whenever applicable, the SPS Curriculum ad applicable sports development programs into its instructional design framework. Qualified teachers, trainers, and coaches shall employ appropriate pedagogies to ensure a holistic development approach, fostering both academic and athletic excellence. This will be supported by adequate resources and inclusive access, creating an environment wher student-athlete can thrive in both sports and education.
6.3
Provision of Learning Resources. All learning resources shall undergo the necessary process of quality assurance by DepEd, PSC, and NAS, in accordance with national policies and international standards.
6.4
Assessment and Evaluation. Student-athletes shall be assessed and evaluated based on the standards set by DepEd, in coordination with NAS. Assessments shall include academic evaluations, athletic performances, portfolio reviews, and exit assessments.
6.5
Stakeholder Participation. To achieve an enhanced and responsive school curriculum, the Sports High School shall undertake consultations with other national government agencies and other stakeholders with proven and established track record in the promotion of sports education.


SEC. 7. Organizational Structure and Staffing Pattern. – The organizational structure and staffing pattern of the School shall be prescribed by DepEd, subject to the approval of the Department of Budget and Management.
Within one hundred twenty (120) days upon the effectivity of this IRR, the Sports High School shall submit a five (5)-year development plan, including its corresponding budgetary program to DepEd, and set up its organizational, administrative, and academic structure.

RULE IV
HIRING AND CONTINUING PROFESSIONAL DEVELOPMENT
SEC. 8. Hiring of Secondary Education Teachers. – The hiring of secondary education teachers shall follow the applicable guidelines in the recruitment, selection, and appointment guidelines of DepEd. 
The different art specializations shall be handled by teachers whose areas of specialization, among others, are in physical education, sports science, and sports management.
Guided by the CSC-approved qualification standards, the qualifications of teachers teaching specialized subjects shall be specified in a separate guidelines to be issued by DepEd.

SEC. 9. Hiring of Coaches, Accredited Trainers and Consultants. – DepEd may hire coaches, accredited trainers or consultants in the fields of sports and sports science. The hiring of these individuals shall be in the nature of contract of service, highly technical consultants, or other similar nature of hiring, consistent with relevant laws, rules, and regulations. 
They shall be engaged on a part-time basis for a maximum period of one (1) school year renewable at the option of the head of Schools Division Office of Baguio City. 

SEC. 10. Professional Development . – To ensure that the School’s sports program meets the demand for quality teachers and school leaders, DepEd, in consultation with PSc and NAS, shall conduct teacher education and training programs, in collaboration with relevant partners in government, academe, industry, and nongovernmental organizations. Such professional development programs shall be initiated, conducted, and evaluated regularly to ensure constant upgrading of teacher skills. Teacher education and training programs shall include, but not limited to:

Continuing Professional Development of Teachers. School teachers shall be trained to enhance their pedagogical skills to meet the content and performance standards of the SPS curriculum.
10.2
Continuing Professional of Instructional Leaders. School administrators and other instructional school leaders shall likewise undergo sports management workshops and training to enhance their skills in their roles in academic and administrative management.


SEC. 11. Creation, Recruitment, Selection, and Appointment of School-based Personnel. – The DepEd, in consultation with the Department of Budget and Management (DBM), shall initiate the creation of items of the necessary teaching, teaching-related and non-teaching personnel in the Sports High School, consistent with existing guidelines and school organizational structures and staffing patterns.
The recruitment, selection, appointment, and deployment of teaching, teaching-related and non-teaching personnel of the School for the Arts shall be guided by the existing DepEd guidelines, in accordance with the rules and regulations of the Civil Service Commission, DBM, and other relevant government agencies.

SEC. 12. Inclusion of the School in DepEd’s Program of Expenditure and Its Management Information Systems. – DepEd shall immediately include in its program of expenditures and shall ensure the provision of basic education inputs, necessary in each school’s operations, including adequate instructional rooms and ancillary facilities such as sports facilities, sports supplies, sports equipment, as may be necessary, that are compliant with the minimum service standards and appropriate to the needs of its student-athletes and teachers. 
DepEd shall likewise include the said School in the Enhanced Basic Education Information System, the Learner Information System, and other management information systems of DepEd. 

SEC. 13. Guidelines on the Establishment of Baguio City Sports High School. – DepEd may formulate and implement additional guidelines on the establishment of Baguio City Sports High School, as may be necessary. 

RULE V
FINAL PROVISIONS
SEC. 14. Transitory Provision. – DepEd, having jurisdiction over the Sports High School shall, as may be necessary, immediately initiate the formal acquisition and establishment of its school site under the name of DepEd and include in its budget proposal the budgetary requirements of the priority equipment and facilities.

Provided that, the establishment of the Sports High School shall be consistent with the procedure laid down in existing policies on the establishment of public schools.
The Secretary of Education shall immediately include in the DepEd’ s program the operationalization of the High School for Sports, the initial funding of which shall be charged against the current year’s appropriation of the Schools Division Office of Baguio City. Thereafter, the amount necessary for the continued operation of the School shall be included in the annual General Appropriations Act. 

SEC. 15. Separability Clause. If any provision or part of this IRR is declared invalid or unconstitutional, the remaining provisions not affected shall remain in full force and effect.

SEC. 16. Repealing Clause. All DepEd Orders and other related issuances, rules, and regulations inconsistent with this IRR are hereby repealed, rescinded, or modified accordingly.

SEC. 17. Effectivity. – This IRR shall take effect immediately after its publication in the Official Gazette or in a newspaper of general circulation.
Three certified copies of this IRR shall be filed with the Office of the National Administrative Register at the University of the Philippines Law Center, UP Diliman, Quezon City.
