PEOPLE OF THE PHILIPPINES, PLAINTIFF-APPELLEE, VS. RUEL DOLLISEN Y ESCOBAR, ACCUSED-APPELLANT.

Decisions / Signed Resolutions September 23, 2014 FORMER FOURTH DIVISION CARANDANG, J.:

CARANDANG, J.:

This treats Accused-Appellant’s Motion for Reconsideration of Our decision dated September 23, 2014 which affirmed his conviction for Homicide.

Accused-appellant insists that this Court erred in not appreciating self-defense in his favor.

We find that the Accused-appellant’s arguments are mere rehash of his arguments in his appeal which We have already discussed lengthily in the decision sought to be reconsidered.

Moreover, it should be remembered that the victim sustained four (4) stab wounds[1] ranging from 3 centimeters to 8 centimeters deep. The Supreme Court ruled that “the nature and number of wounds inflicted by the accused are considered as important indicia which disprove self-defense because they demonstrate a determined effort to kill the victim, not just to defend himself.”[2]

To reiterate, accused-appellant failed to present strong, clear and convincing evidence to prove self-defense.

In view thereof, the instant motion is hereby DENIED.

SO ORDERED.

Gonzales-Sison, and Sorongon, JJ., concur.
