Petitioners JCA Bayan Corporation, Jaime Bayan and Angelina Bayan – along with respondent Equitable Savings Bank now BDO Unibank, Inc. – filed this Joint Motion To Dismiss for the reason that the parties have entered into a Compromise Agreement that comprehensively settled the main case now peding before public respondent court.

In essence, respondent BDO agreed to sell the property subject of the dispute to petitioner JCA Bayan for the sum of P9M which is payable on 02 April 2014 and, in consideration of which, the petitioners herein agreed to cause the dismissal of the various cases they filed against herein respondents, including the instant petition.
Premised on the foregoing, the Court finds the motion in order. Cerainly, an agreement to end a litigation is not only allowed, but even encouraged in civil cases.[1]
WHEREFORE, in view of the foregoing, the petition is DISMISSED.
