IMUS RURAL BANK, INC., PETITIONER, VS. ATTY. MICHELLE JAN B. BABIANO, IN HER CAPACITY AS HLURB ARTBITER; SHERIFF RIZALDY P. LONGAKIT (DEPUTY SHERIFF OF THE REGIONAL TRIAL COURT …

Decisions / Signed Resolutions June 13, 2002 FORMER SEVENTH DIVISION BALTAZAR-PADILLA, J.:

BALTAZAR-PADILLA, J.:

Record reveals that on September 15, 2014, a Decision was promulgated, the dispositive portion of which provides, viz:

“WHEREFORE, premises considered, the assailed November 27, 2013 Order of the HLURB is SET ASIDE insofar as the order imposing the amount of P1,845,000.00 against Imus Rural Bank and the directive for the Register of Deeds of Las Piñas City to register and transfer TCT No. T-52086 in favor of Nestor Borromeo, are concerned. The order for the Ex-Officio Sheriff to execute the necessary Deed of Sale is maintained. Consequently, the Notice to Pay and Notice of Garnishment issued by Sheriff Longakit demanding IRB to pay the amount of P1,845,000.00 are ordered NULLIFIED.

The Decision dated June 13, 2002 of the HLURB in HLURB Case No. REM-042600-10977 is remanded for proper execution until fully satisfied in accordance with the terms of its dispositive portion.

The writ of preliminary injunction earlier issued enjoining the execution of the November 27, 2013 Order in HLURB Case No. REM-042600-10977 is hereby made permanent except only with respect to the directive for the Ex-Officio Sheriff to execute the pertinent Deed of Sale in favor of Borromeo.

SO ORDERED.”[1]

Dissatisfied therewith, respondents filed a Motion for Reconsideration of the said Decision. Comment/Opposition to the Motion was filed by petitioner.

A judicious evaluation of the said Motion discloses that no convincing and justifiable reason was advanced by the movant that would convince US to modify, alter, much less, reverse the questioned Decision. The allegations and arguments therein embodied had already been amply discussed and passed upon by US. To reiterate OUR ruling on the same will only result in mere redundancy.

WHEREFORE, on account of the foregoing, the Motion for Reconsideration of respondents is hereby DENIED.

SO ORDERED.
