SPOUSES EMILIANO SALONGA AND MINDA SALONGA REPRESENTED BY GREGORIO SALONGA AS THEIR ATTORNEY-IN-FACT, PLAINTIFFS-APPELLANTS, VS. CITIZEN’S RURAL BANK (CABIAO) INC., THE REGISTER…

Decisions / Signed Resolutions October 1, 2010 FORMER SPECIAL SECOND DIVISION SALAZAR-FERNANDO, J.:

SALAZAR-FERNANDO, J.:

On January 22, 2014, this Court granted the appeal[1] and reversed the order of dismissal dated October 1, 2010,[2]
of the Regional Trial Court (RTC), Branch 36, Gapan City, Nueva Ecija
in Civil Case No. 3604-09. On February 11, 2014, defendants-appellees
filed a Motion for Reconsideration,[3]
still insisting that the case should be dismissed by reason of res
judicata
and for violation of the rule on forum shopping.
Plaintiffs-appellants were required to comment[4] on the motion, which they filed on April 4, 2014.[5]

An analysis of the motion divulges that defendants-appellees
professed the same arguments they raised in their previous pleadings.
These contentions were already considered and ruled upon by this Court
in its assailed decision. Thus, without any new matter that would
justify a reconsideration, this Court will uphold its findings.

WHEREFORE, premises considered, defendants-appellees’ Motion for Reconsideration is hereby DENIED for lack of merit.

SO ORDERED.
