UNIVERSITY OF IMMACULATE CONCEPCION AND MO. MARIA ASSUMPTA DAVIV, RVM., PETITIONERS, VS. NATIONAL LABOR RELATIONS COMMISSION, 8TH DIVISION, CAGAYAN DE ORO CITY AND UIC TEACHING …
CONTRERAS, J.:
WHEREFORE, premises considered, the Petition for Certiorari is hereby DENIED. The assailed Resolutions dated November 28, 2007 and January 31, 2008 of the National Labor Relations Commission (NLRC), 8th Division (former Fifth Division), Cagayan De Oro City is AFFIRMED with MODIFICATION that the order against petitioner to pay private respondent double of all the amounts of moral and exemplary damages and representation fee is DELETED. Corollary thereto, the Labor Arbiter’s award of damages and attorney’s fees are hereby REINSTATED.
SO ORDERED.
Petitioners duly filed an Opposition to the Union’s Partial Motion for Reconsideration.[5] Likewise, respondent filed a Comment to the Petitioner’s Partial Motion for Reconsideration.[6]
After a conscientious study of the partial motions for reconsideration of both parties vis-à-vis with their respective opposition and comment thereof, this Court opines that the allegations therein are mere rehash of the arguments raised in the pleadings, which were already considered and passed upon in rendering the assailed decision. Both parties failed to raise new substantial matter nor present compelling reason to warrant a reversal of the assailed decision. Hence, both partial motions for reconsideration are DENIED.
SO ORDERED.
