On October 10, 2014, the Court’s Judicial Records Division (JRD) informed the Branch Clerk of Court (BCC) of the Regional Trial Court (RTC), Branch 28 Liloy, Zamboanga del Norte that the records of the case elevated on appeal were incomplete. Specifically, it was pointed out that there were no markings on the exhibits and no pagination in the original records. Thus, the said BCC was required to submit within ten (10) days from notice the pertinent documents and to make the necessary corrections.

On October 22, 2014, the concerned BCC requested this Court that the entire records of the case be sent back to the court of origin in order to make the necessary rectifications.

Finding the above manifestation meritorious, the Court hereby DIRECTS the JRD to return the entire records of the case to the court of origin and ORDERS the BCC to undertake the marking of exhibits and pagination of the records.

The Court enjoins the BCC to expedite compliance with its October 10, 2014 directive and to forward the corrected records of the case back to this Court within fifteen (15) days from receipt thereof.

Meanwhile, any action on this case is held in abeyance pending compliance with this Resolution.
