FABSHOP/ HIPSTOP/ MARK LUA, PETITIONER, VS. NATIONAL LABOR RELATIONS COMMISSION, SIXTH DIVISION, PUBLIC RESPONDENT, MELINDA FACULARIN, MYRNA PEREABRAS, IRENE ANDAG AND JOLLY COR…

Decisions / Signed Resolutions April 18, 2012 SPECIAL FORMER EIGHT DIVISION BALTAZAR-PADILLA, J.:

BALTAZAR-PADILLA, J.:

Record reveals that on August 28, 013, a Decision was promulgated, the dispositive portion whereof provides, viz:

“WHEREFORE, premises considered, the assailed Decision of the National Labor Relations Commission dated April 18, 2012 is MODIFIED. Private respondents’ complaint for illegal dismissal is hereby DISMISSED. The award of backwages, separation pay and attorney’s fees is, thus, DELETED.

The order awarding service incentive leave pay, the proportionate 13th month pay for the year 2009 and salary differentials in favor of private respondents in the amounts computed by the NLRC is, however, SUSTAINED.

SO ORDERED.”[1]

Dissatisfied therewith, private respondents filed a Motion for Partial Reconsideration of the said Decision.

A judicious evaluation of the said Motion discloses that no convincing and justifiable reason was advanced by the movants that would convince US to modify, alter, much less, reverse the questioned Decision.

WHEREFORE, on account of the foregoing, the subject Motion for Partial Reconsideration is hereby DENIED.

SO ORDERED.
